02. 12.08.2015 None appears on behalf of the parties due to resolution passed
 by the Orissa High Court Bar Association to cease work.

 On perusal of the pleadings made in the writ petition, it transpires that the
decision at the first instance is to be taken for determining the claim of the petitioner by t
he opposite parties.

 Hence, without going into the merit of the claim of the petitioner, the writ p
etition is disposed of giving liberty to the petitioner to file fresh representation along wit
h the certified copy of this order before the opposite party no.2- Collector, Kendrapara who w
ill take decision within a reasonable period preferably within eight weeks from the date of re
ceipt of representation by passing the speaking order after providing an opportunity of being
heard to the petitioner including affected parties, if any.

 If the opposite party no.2 will come to conclusion that the petitioner is enti
tled to be given consequential benefit, same shall be extended in his favour within four weeks
 from the date of such decision as indicated in the preceding paragraph.
 If the opposite party shall come to finding that the petitioner is not entitled to be gi
ven such benefit, same shall be communicated to him by passing a speaking order within the per
iod aforesaid.
 With such observation and direction, the writ petition is disposed of accordingly.
