03. 09.12.2015 Heard learned counsel for the petitioner a
nd learned Addl. Standing Counsel for the State.
The petitioner is implicated in the offence punishable U/S. 395 IPC.
Neither the petitioner has been named by the co-accused persons nor was he put
to the T.I. Parade.
The basis of his implication is statement of a labourer, who saw the petitione
r standing near the stock of stolen wheat.
The case is stated to have been committed to the court of Sessions, in the mea
ntime.
Considered the materials placed by learned counsel for the parties.
Taking into consideration the facts and submissions, factum of permanent resid
ence of the petitioner, nature of evidence and the stage of the proceeding, it is directed tha
t the petitioner shall be released on bail by the learned Addl. Sessions Judge, Talcher in C.T
.(S) Case No.30 of 2015 on such terms and conditions as deemed just and proper, including the
following conditions :-
(i) The petitioner shall appear before the I.I.C., Samal P.S. once in a week on the day and ti
me fixed by the said I.I.C. till conclusion of the trial in all the cases pending against him.
(ii) The petitioner shall not involve himself in similar or any other offence during currency
of this order.
The bail application is accordingly disposed of.
