27.08.2015 Heard learned counsel for the petitioners and the learned Addl. Government Advocate.
The petitioners are apprehending arrest for the alleged commission of offences under S
ections 341, 279, 337, 323, 294, 506 and 379/34 of the I.P.C. in G.R. Case No.220 of 2013 of t
he court of S.D.J.M., Banki, arising out of Banki P.S. Case No.171 of 2013.
Keeping in view the nature of allegations and the facts of the case, this Court is inc
lined to grant anticipatory bail to the petitioners. Learned counsel for the petitioners submi
ts that in the meantime charge-sheet has been filed against the petitioners.
It is directed that the petitioner is given liberty to surrender before the learned S.
D.J.M., Banki within 21 days in connection with the aforesaid case and apply for bail. In such
event, the learned Magistrate shall release them on bail on such terms and conditions as deem
ed just and proper by him.
It is further directed that on the event the petitioners are arrested in the meantime,
the Arresting Officer shall produce them before the learned S.D.J.M., Banki within 24 hours a
nd the learned Magistrate shall grant them bail as directed above. Learned counsel for the pet
itioners submits that in the meantime charge-sheet has been filed in this case.
The ABLAPL is accordingly disposed of.
