3. Learned counsel for the petitioner submits that in the mean time, the houses constructed h
ave been handed over to the persons with whom he has entered into an agreement for delivery of
the house after construction. In evidence thereof, the petitioner files three documents in Co
urt today titled as Memorandum Evidencing Delivery of Possession. Perusal of the said document
s reveals that the petitioner has signed on the documents as the capacity of the Managing Dire
ctor of the Construction Company. On the other hand, the persons who allegedly delivered posse
ssion have not signed on the documents It is apparent from the record that these documents are
self-serving documents prepared by the petitioner. Learned counsel for the petitioner has sub
mitted the documents without verifying the fact that the allottees have signed it or not.
4. On the top of it, learned counsel for the informant files two separate affidavits of two p
ersons, namely, Pradipta Kumar Mohanty and Debraj Sahoo, indicating that the houses already co
nstructed by the petitioner have not delivered to them.
