In this Misc. Application (MA), the Applicant has made the following

prayer:-

“1. Pass an order clarifying that the observation in paragraph 7 of the Order dated 19.12.2024 (Annexure A-2), recording that the proprietor "will ensure compliance of closure directions till further orders of UPPCB and Tribunal", alongside the Order dated 27.03.2025 (Annexure A-3), shall not operate as an impediment; and consequently, direct Respondent No. 1 (UPPCB) and Respondent No. 2 (Ground Water Department, UP) to independently process the Applicant’s applications, representations, conduct necessary inspections to verify physical and technical compliances, grant the NoObjection Certificate (NOC) / Registration for Well, and revoke the Closure Order dated 07.11.2024 (Annexure A-1) upon verification, purely on their own merits, in a time bound manner.

2. Pass any other or further orders as this Hon'ble Tribunal may deem fit and proper in the interest of justice and equity.”

This MA has been filed in the MA No. 43/2026 in OA No. 304/2024. Therefore, in this MA the Applicant cannot seek the clarification of order

dated 27.03.2025 which has been passed in the OA No. 122/2025.

Learned Counsel for the Applicant has submitted that the order

needs to be clarified because the concerned Authority in Annexure A-22

had referred to the order of the Tribunal in OA No. 122/2025 while rejecting the application for no objection/registration under the Uttar Pradesh Ground Water (Management and Control) Act 2019. Reference to the order and the OA in Annexure A-22 does not relate to this OA and the order passed in this OA No. 304/2024.

So far as the order dated 14.12.2024 passed in the MA No. 56/2024 in OA No. 304/2024 is concerned, the Tribunal had disposed of the OA recording the statement of the proprietor-Ram Babu Gupta without issuing any direction. Therefore, no clarification in that order is required.

The MA is accordingly found to be misconceived which is dismissed.
