In this Original Application (OA), the Applicant has alleged that the Respondent No. 1 is running the AARA machine at Kartala Road, Kaysthan, Sidhpura, Kasganj, Uttar Pradesh and is causing health hazards.

Learned for the Applicant submits that AARA machine of Respondent No. 1 is causing noise and air pollution and affecting the health of the villagers specially school going children and the senior citizens who are suffering from the breathing problem and hearing issue.

Learned counsel for the Applicant has pointed out that a complaint dated 11.06.2026 annexure P-1 was made to the UP PCB but no action has been taken till now. Considering the nature of grievance raised in the OA, we are of the view that the UP PCB should carry out the ground verification and ascertain the violation of environmental norms by the Respondent No. 1 and take appropriate action, if the allegations of the Applicant are correct. Hence, we dispose of the OA directing the Respondent No. 3-Member

Secretary, UP PCB to ensure that the complaint of the Applicant dated 11.06.2026 is duly look into and the spot inspection is done and if any violation of the environmental norms by the AARA machine run by the Respondent No. 1 is found, appropriate remedial and punitive action is taken in accordance with law by following principle of natural justice.

Let this exercise be completed within a period of three months from date of receipt of copy of this order.

The Applicant is permitted to submit a copy of this order to the Respondent No. 3 along with a copy of the complaint dated 11.06.2026.
