ORDER

In this Original Application, the applicant has prayed for a direction to the respondent to declare the Corbett National Park, Uttarakhand as Eco-Sensitive Zone (ESZ).

It has been pointed out that the same issue concerning declaration of the Jim Corbett National Park along with Rajaji National Park as EcoSensitive Zone is under consideration before the Hon’ble Supreme Court.

Learned counsel for the applicant has produced a copy of the order dated 05.03.2025 passed in IA No. 285881 of 2024 and connected IA’s in Writ Petition(s) (Civil) No. 202/1995 in RE: T.N. Godavarman Thirumulpad vs. Union of India & Ors. The said order reads as under:

“1. Vide our order dated 20.02.2025, we had directed the State of Uttarakhand to complete the formalities qua Eco-Sensitive Zone (ESZ)

of both Rajaji National Park and Jim Corbett National Park within a period of two weeks from the date of the said order.

2. In pursuance to the said order the State ought to have filed its compliance affidavit by today.

¶19

3. Shri A.K. Sharma, learned counsel appearing for the State of Uttarakhand, submits that since the Court had granted two weeks’ time, which was to expire today the State was under an impression that it could file its compliance affidavit any time during the course of the day today.

4. When the matter was specifically listed today, the least State could have done was to be ready with the compliance affidavit.

5. Be that as it may, we are inclined to keep the matter for hearing on 19.03.2025.

¶22

6. We clarify that any lethargy on the part of the State in this matter would not be taken lightly by this Court.”

Since the Hon’ble Supreme Court is already considering the issue

which is involved in this OA. Therefore, we do not deem it proper to parallelly examine the same issue.

Hence, we dispose of the O.A. taking note of the order of the Hon’ble Supreme Court.
