The applicant is a welfare association of permanent residents of the Village Nizampur, North-West Delhi – 110081. The plea of the applicant is that on Nizampur-Bahadurgarh road opposite to and Nizampur-Tikri road inside Haryana (part of Chhotu Ram Nagar) there are more than 100-125 illegal and unauthorized plastic factories which are operating and burning plastic waste indiscriminately for last 8 – 9 years. The applicant alleges that every day thousands of tons of plastic waste is being burnt by these factories to make plastic bricks.

Learned counsel for the applicant has pointed out that earlier the grievance was raised by the applicant before the District Magistrate, Jhajjar who had passed the order under Section 163 of Bhartiya Nagrik Suraksha Sanhita, 2023 taking note of the issue of burning of plastic waste and resultant pollution thereafter the Haryana State Pollution Control Board (HSPCB) by order dated 25.02.2025 had taken action and had issue direction for disconnection of the electricity and that order was also complied with and electricity connection of those units was disconnected. Learned counsel submits that subsequently again the units have started illegally operating by obtaining the electricity connection.

The records reflects that on earlier complaint of the applicant due action was taken by the District Magistrate, Jhajjar and HSPCB. Hence if again any violation has taken place the faster and appropriate remedy available to the applicant is to file a complaint to the Member Secretary, HSPCB along with all the details. If such a complaint is filed by the applicant, the Member Secretary, HSPCB will ensure the spot inspection and if the alleged units are found to be operating in violation of the environmental norms, then immediate punitive and remedial action will be taken.

The Member Secretary, HSPCB will ensure that appropriate action is taken within three months from the date of receipt of the complaint.
