By filing IA No. 871/2025 in OA No. 106/2022(WZ), the Applicant-

Vidyadhar Durgekar has made the following prayers:-

“1. To direct the respondents to amened the CZMP 2019 by changing the Karwar Coast being on the Sea coast as the Seafront for which the 500 metre limits is prescribed and not present mapping of 50 meters.

2. To direct the respondents to remove the marking of the port limits from the CZMP 2019 since it was done arbitrarily and not marked in the proposed draft and not brought to the notice of the public and the fishermen as per the requirements of the CRZ Notification 2019.

3. To direct the respondents to include the Karwar coast as the CVCA in the CZMP 2019 as mentioned in the paragraph 3.1 of the CRZ Notification 2019.

4. To direct the respondents to change the marking of CRZ II as CRZ IA and NDZ in the CZMP 2019 since the beach has no population nor any habitation.”

The Tribunal in this OA is examining the issue of validity of certain provisions of CRZ Notification, 2019 whereas in the IA the Applicant has sought a direction for amendment of the CZMP, 2019.

Hence, the relief which the Applicant in the IA is seeking does not fall within the scope of consideration of this OA. That apart the OA is now at the final stage. Hence, the IA is disposed of. However, with liberty to the Applicant to take up such other remedies as are available in law.

Shri Akash Rebello, learned counsel for the Applicant in OA No. 106/2022(WZ) has commenced his argument. The matter is part-heard.
