In compliance with our previous order dated 23.03.2026, learned counsel for the applicant has filed three documents through I.A. No.193 of 2026 (WZ).

We allow the above I.A. and direct the Registry to take on record the said documents.

We are passing this order in continuation to the earlier orders dated 10.02.2026 and 23.03.2026.

Our attention is drawn by learned counsel for the applicant to page nos.62 to 63 of the paper book, which is an information obtained by the

applicant under RTI from the office of Tehsildar & Executive Magistrate, Poladpur, District: Raigad, wherein it is mentioned that citizens have frequently complained regarding the collection and dumping of solid waste from the city into the riverbed by the Poladpur Nagar Panchayat and pursuant thereto, instructions have been issued to the Poladpur Nagar Panchayat regarding this matter.

Our attention is also drawn by learned counsel for the applicant to page nos.59 to 60 of the paper book, which is a letter dated 16.10.2025 written by the Chief Officer, Nagar Panchayat, Poladpur addressed to the Regional Officer, Maharashtra Industrial Development Corporation (MIDC), in which in para no.3, it is recorded “since the Nagar Panchayat currently lacks the necessary land and there is no other government land available in the city, waste is being dumped at the traditional site along the riverbed….” .

In view of above documentary evidences, which have been extended to us by learned counsel for the applicant, there appears to be illegal dumping of the Solid Waste being done by the side or inside the riverbed of Savitri river. Therefore, we find substantial question relating to environment is made out in the present Original Application, therefore, we deem it appropriate to admit this application and accordingly admit the same.

Registry is directed to issue Notice to the Respondents, returnable within 04(four) weeks.

Applicant is directed to take necessary steps for service to the Respondents by both ways (Dasti as well as by Registered Post) and also on available e-mail/WhatsApp., and submit service affidavit within one week.

Applicant is also directed to supply copy of the application and relevant documents to the Respondents within a week.

Respondents are directed to submit their reply affidavits within four weeks through e-filing and also circulate the same to the applicant and also the other Respondents by available e-mail.

Rejoinder, if any, is directed to be submitted within one week thereafter.
