This appeal has been filed seeking quashing of the Environmental Clearance (EC) dated 21.09.2025 issued by respondent no.1-SEIAA to the extent that it keeps 242.12 sqms of the project site in abeyance as “wetland area” and direct the appellant to obtain a NOC from State Wetland Authority.

The appeal has been filed with the delay of 33 days, for condoning which IA 866/2025 has been moved. No objection has been filed against the same by the respondents. Therefore, same is allowed.

Against the main appeal, from the side of respondent no.1-SEIAA and respondent no.5-State Wetland Authority, Mr. Aniruddha Kulkarni, Learned Counsel has put in appearance and states that he has no objection

to the EC dated 21.09.2025 being quashed to the extent that it directs to keep 242.12 sqms of the project site in abeyance as wetland area.

From the side of respondent no.2-MoEF&CC, Mr. Om Shankar Shrivastava, Learned Counsel has put in appearance and states that he does not want to file reply.

From the side of respondent no.3-MPCB, Ms. Mansi Joshi, Learned Counsel has put in appearance and states that she does not want to file reply.

No one has appeared from the side of respondent no.4.

Since the respondent no. 1 and 4 have conceded prayer made by project proponent/appellant, therefore, we quash the EC to the extent that it keeps 242.12 sqms of the project site in abeyance as wetland.

Accordingly, we dispose of this appeal.
