Respondents no.1 and 2 have filed I.A. No.79/2026/EZ for waiver of costs on the ground that respondent no.4- RMC had been directed to file response on behalf of respondents no.1 and 2. Any such direction to respondent no.4 by respondents no. 1 and 2 did not exempt them from responsibility to ensure that appropriate response on their behalf was filed. No response was filed by them or on their behalf despite grant of three adjournments. Costs were imposed on respondents no. 1 and 2 vide order dated 07.04.2026 for detailed reasons mentioned therein. No sufficient and valid ground for recall of above said order and waiver of costs is made out. Accordingly, I.A. No. 79/2026/EZ is dismissed.

Costs may be deposited by respondents no. 1 and 2 within one month in terms of order dated 07.04.2026 with the learned Registrar of this Tribunal at Kolkata.

Affidavit dated 29.06.2026 has been received from respondent no.4 through email dated 30.06.2026. Respondent no.4 is directed to e-file the same within one week.

Learned counsel representing respondent no.5 seeks some more time for filing of its response.

Reply by respondent no.5 may be filed at least one day before the next date of hearing fixed.
