Learned Counsel Mr. Harshwardhan Tiwari has pressed this application and summitted that the residential houses and livelihood are likely to be directly impacted by any eviction or removal action and they are affected parties, thus, proper and necessary parties and they may be impleaded as Respondents.

In view of the above facts, since any order or proceeding may affect the right, title and interest of the person and they are proper and necessary parties, the I.A. No.46/2026 is allowed and the Applicants in the I.A. are impleaded as Respondents. Steps be taken within a week. The proposed Respondents are directed to submit the reply within two weeks.

Respondent Nos.2 & 4 have filed the reply with the facts that some of the encroachments have been removed and rest are under process. The District Magistrate concerned is directed to remove the encroachments from the water body and submit the further action taken report within three weeks.

Learned Counsel for the Respondent/State PCB has submitted that necessary actions for calculation and realization of environmental damage are being in process and notices are being issued to the violators for depositing the environmental damage. The same may be completed within two weeks and detailed report be filed before the next date of listing.
