By this Execution Application, the Applicant has sought compliance of the order dated 26.04.2023 passed in MA No. 33/2023 in OA No. 75/2023.

The grievance raised by the Applicant in the above MA/OA was against the unscientific handling of solid waste in village Jagjeevanpur, Paragana, Jalalabad, Tehsil & District Ghaziabad, Uttar Pradesh. The Tribunal by order dated 26.04.2023 had disposed of the MA No. 33/2023 by directing as under:-

6. In view of above, the District Magistrate and Ghaziabad Nagar Nigam may take further remedial measures as per law and give their report to the Chief Secretary, UP within one month from today. The Chief Secretary, UP may review the compliance status and ensure further remedial action and send a separate report along with the

report to be filed in O.A. No. 606/2018 with the Registrar General of this Tribunal. If found necessary, the registry may place the matter before the Bench for further orders. The report may give status of legacy waste at the site in question and any other site apart from Jagjeevanpur, apart from status and adequacy of waste processing facilities.

During the pendency of this Execution Application the progress reports from time to time were filed by the Respondent-Ghaziabad Nagar Nigam (GNN). The latest progress/compliance report dated 06.04.2026 discloses the following action which the Respondent-GNN is taking to remediate the issue and comply with the earlier order of the Tribunal:-

“I. DISCLOSURE OF DETAILS ON WASTE GENERATION, ITS TREATMENT, PROCESSING AND AVAILABILITY OF FACILTIES:-

a. The aspects of waste generation are as follows:

Approximately 70,000 MT of waste is currently at the site. The target for processing the waste and clearing the site is set for 30 June 2026.	(i) Since 2025, transpor to this s closed stopped. Jagjivanpur Bhikanpur Legacy Waste Site having 2.69 lac ton	1200 TPD	The legacy waste processing started from October 2023 and the entirety of legacy waste has been processed. The space created by processing of legacy waste was being used for processing of fresh MSW. However, that is also stopped since July 2025. Learned Senior counsel for the GNN submits that the timeline of 30.06.2026 given in the above table will be duly adhered to and entire waste which is lying dumped in Jagjeevanpur Site will be cleared. He has further pointed out that no fresh waste is being dumped in that site from 06.07.2025 and the present existing waste in that site is approximately 70000 MT which will be duly cleared within the timeline given. He has further submitted that so far as the Jagjeevanpur/Bhikanpur legacy waste site is concerned the waste from that site was cleared and only the fresh waste upto 05.07.2025 was stored which will now be processed and cleared by 30.06.2026.

Having regard to the above, we find that the necessary action in compliance of the order of the Tribunal has already been initiated/taken and will be completed by 30.06.2026.

The Applicant has raised an issue that the Applicant is entitled to adequate environmental damage compensation (EDC) for her sufferings on account of delayed action. Since it is the Execution Application and in the original order there is no direction in this regard, therefore, the Applicant will be at liberty to raise the issue of EDC in separate proceedings. He has also submitted till the entire waste is lying dumped in the site in question is cleared adequate measures should be taken by the Respondent-GNN for vector control to which learned senior counsel for the Respondent-GNN has not disputed.

Hence, the Execution Application is disposed of by directing the Commissioner, GNN to file the action taken report in the first week of July, 2026 with the Registrar General of the Tribunal by email at [email protected] disclosing that the action in terms of the above tabulated information has been completed by the cut of date of 30.06.2026. If deemed necessary, the matter will be listed for consideration before the bench again.
