In this original application, the Applicant has alleged that the Respondent No. 8 is illegally carrying out the construction at Khasra No. 468, Village Bisanpur Jharda Ahatmal, Tehsil and District-Haridwar. The Applicant alleges that this construction is within 100 meters of the River Ganga and such construction is prohibited in terms of the orders of the Tribunal dated 13.07.2017 and 15.12.2017 in O.A. No. 200/2014.

The flood plain of river Ganga has been defined/is being defined and demarcated in terms of the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016 which has been issued under the Environment (Protection) Act, 1986 and has the statutory force. Nothing has been placed on record to indicate if the flood plain in the concerned area has been demarcated and the construction in question is falling within the flood plain.

Learned Counsel for the Applicant has pointed out that Applicant has submitted the representation on 25.02.2025 to the District Collector,

Haridwar, who is the Chairman of the District Ganga Protection Committee, but the said representation has not been considered till now.

Since a representation/complaint has already been made to the District Collector, Haridwar (Head of the District Ganga Committee) and the allegation which is made by the Applicant requires ground verification, therefore, the OA is disposed of by directing the District Collector, Haridwar to duly consider the complaint of the Applicant, carry out the ground verification and ascertain if the Respondent No. 8 is carrying out permanent construction in the prohibited area. If the allegation is found to be correct, necessary action by following the principles of natural justice, will be taken by the District Collector, Haridwar expeditiously. IA No 469/2026 also stands disposed of.
