Learned counsel appearing for the Respondent No.1-UP PCB has pointed out that along with the reply dated 14.03.2026, the calculation of environmental compensation which is required to be imposed upon the Respondents-Brick Kilns for illegal operation has been given in Annexure -19 (page 249). Hence, it will be open to the Respondents – Brick Kilns to file reply to the said calculations, so that appropriate orders can be passed by the Tribunal in respect of imposition of environmental compensation.

The Affidavit of service filed by the Applicant reveals that the Respondents No. 10 and 13 are not served. Hence, the counsel for the Applicant is directed to serve the Respondents No. 10 and 13 and file fresh affidavit of service.

I.A. No. 189/2026 has been filed on behalf of one Vipin Kumar Pandey for impleadement. Learned counsel appearing for the Applicant in the IA submits that this applicant is to be impleaded as the co-Applicant in the OA. The IA has been filed by the same counsel who has filed the OA but the submission is that the notice be issued to the original applicant so that his stand can come on record.

Without the permission of the original applicant, the co-Applicant cannot be impleaded in the OA. No such permission has been placed on record by the counsel for the original Applicant. Even otherwise, the OA is now at the advance stage, hence, we do not find any justification to allow the IA No. 189/2026, which is accordingly rejected.
