The Applicant- Mr. Anupam Verma, District President, Bhartiya Kisan Union (Tikait), Barabanki, District, Uttar Pradesh has sent to this Tribunal by post the present letter petition dated 17.11.2023 (Pages 1 and 2 of the paper book), which was treated and registered as Original Application (O.A.) No. 841/2024 for exercise of suo motu jurisdiction as per observations made by Hon’ble Supreme Court in Municipal Corporation of Greater Mumbai

Grievances of the applicant

The applicant has raised the grievances that Slaughter House, named M/s Amroon Foods Private Limited, situated in Barabanki is discharging untreated effluents and dumping animal remains into River Reth in violation of environmental norms causing water and air pollution, damage to environment and posing health hazards to local inhabitants.

जनकहत में लनिेदन है कक आपका ध्यान असरून फूड्स प्राइिेट लिलमटेड, जजिा बाराबंकी में स्िाटर हाउस में व्याप्त अलनयलमतताओं की ओर आकवषित करना चाहता ह जैसा की ज्ञात है कक स्िाटर हाउस चिाने के ू लिए माननीय सुप्रीम कोटि एिं नेशनि ग्रीन किब्यूनि द्वारा स्पष्ट - कदशालनदेश समय समय पर जारी ककये जाते रहे हैं परन्तु उपरोक्त स्िॉटर हाउस इन कदशालनदेशों का स्पष्ट उल्िघन करता रहा है जो लनम्न है-

जानिरों को याडि में न उतार कर बन्द गाकडयों से सीधे स्िॉटर हाउस के अन्दर िे जाते है। जजसमें जनपद ि पडोसी जनपदों को ककसानों के चोरी ककये हुए जानिरो को काट कदया जाता है।

मानक के विपरीत जानिरों के बच्चों को जो 3 माह के अन्दर होते है ि गर्िस्थ जानिरों को र्ी काटा जाता है जजसका साक्ष्य मौजूद है।

बाि श्रलमकों द्वारा कायि कराया जा रहा है।

फैक्ट्िी से लनकिे जानिरों के अिशेषों ि गन्दा खून ि गन्दा पानी को बगि की रेठ नदी में रात में फेंक कदया जाता है जबकक सेंिि मोटर व्हीकि अलधलनयम 2016 के अधीन स्पष्ट है कक कटान के बाद अिशेषों को बन्द गाकडयों में िाया िे जाया जाएगा अिशेषों को रेठ नदी में बहाने पर आस पास के ग्रामीणों में र्ारी रोष है जो जि प्रदूषण का कारण र्ी बनता जा रहा है पया ि रण अलधलनयम 1986 एिं जि प्रदूषण लनिारण अलधलनयम का खुिा उल्िंघन उपरोक्त स्िॉटर हाउस द्वारा ककया जा रहा है।

स्िॉटर हाउस का बना याडि मानक के विपरीत है क्ट्योंकक याडि से जानिरो को स्िॉटर हाउस तक िे जाने में आम रास्ता अिरूद्ध होता है जजसमें कई गाूँिो की जनता को कविनाई का सामना करना पड़ता है उस याडि को िहाूँ से हटाकर स्िॉटर हाउस के पास बनाया जाये।

फैक्ट्िी पर तैनात डॉक् ट ्रों का पैनि र्ी स्िाटर हाउस के साथ लमिीर्गत में शालमि रहता है जो कक 'मरे हुए बीमार ि गर्िस्थ पशुओं को र्ी जाूँच में पास कर देते है तथा डाक् ट ्रों की पैनि के नाम की लिस्ट ि मोबाइि नम्बर स्िाटर हाउस के गेट पर चस्पा की जाये।

स्िॉटर हाउस के प्रबन्धक िोजो जोसेफ ि उप प्रबन्धक मेराजूद्दीन द्वारा क्षेत्रीय मॉस व्यापाररयों से कटा हुआ माि रात में खरीदते है और उस माि को र्ी सप्िाई करते है।

उपरोक्त मांगो को यकद नहीं माना गया तो मजबूर होकर हजारो ककसानों के साथ 05 कदसम्बर 2023 कदन मंगििार को स्िॉटर हाउस पर धरना प्रदशिन करने को वििश होगा तथा बहार से आने िािे जानिरों को ककसान स्ियं याडि में उतरिायेगे धरना प्रदशिन करते िक्त यकद कोई अवप्रय घटना घटती है तो उसकी समस्त जजम्मेदारी स्िॉटर हाउस ि शासन प्रशासन की होगी।

“Subject:Regarding the irregularities prevalent in Amroon Foods Private Limited, (Slaughter House) Barabanki and stopping the slaughter of animals stolen from farmers of Barabanki district and neighbouring districts .

I would like to draw your attention to the irregularities prevalent in the slaughter house of Amroon Foods Private Limited, District Barabanki in public interest. As it is known that clear guidelines have been issued from time to time by the Hon’ble Supreme Court and National Green Tribunal for running the slaughter house, but the above-mentioned slaughter house has been clearly violating the guidelines, which are as follows-

1. Instead of unloading the animals in the ward, they are taken directly to the slaughter house in closed vehicles. Animals stolen from the farmers of the district and neighbouring districts are slaughtered there.

2. Contrary to the norms, even the babies born within 3 months and pregnant animals are slaughtered, evidence of which is available.

3. Work is being done by child labourers.

¶61

4. The remains of the animals, dirty blood and dirty water coming out of the factory are dumped in the nearby Reth river at night, whereas it is clearly mentioned under the Central Motor Vehicle Act 2016 that after cutting, the remains will be brought and taken away in closed vehicles. There is a lot of anger among

the villagers in the vicinity on dumping the remains in the Reth river, which is also causing water pollution. The Environment Act 1986 and Water Pollution Prevention Act are being openly violated by the above-mentioned slaughter house.

5. The yard built for the slaughter house is not fulfilling the standard because the common path for taking animals from the yard to the slaughter house is obstructed due to which people of many villages have to face difficulties. That yard should be removed from there and built near the slaughter house.

6. The panel of doctors posted at the factory is also involved in collusion with the slaughter house, who pass even the dead, sick and pregnant animals in the examination. The list of names and mobile numbers of the panel of doctors should be pasted on the gate of the slaughter house.

7. Manager of Slaughter House, Lojo Joseph and Deputy Manager Merajudin buy sliced meat from local meat traders at night and supply that too.

8. Dead animals from the area are bought at night and then grinded in a redding machine to make MBM.

9. Animals brought from outside to the slaughter house and other works should be done under the surveillance of CCTV cameras. If the above demands are not accepted, then we will be forced to sit on a dharna with thousands of farmers at the slaughter house on Tuesday, 05 December 2023 and the farmers themselves will get the animals coming from outside unloaded in the yard. If any untoward incident happens during the dharna, then the entire responsibility will be of the slaughter house and the government administration.”

Constitution of Joint Committee and impleadment of respondents

Vide order dated 03.09.2024, this Tribunal constituted a Joint Committee comprising of the District Magistrate, Barabanki, Uttar Pradesh Pollution Control Board (UPPCB) and a representative of Agriculture Produce Export Development Authority (APEDA) with direction to visit the site, collect relevant information and submit factual report within one month .

By the above-said order this Tribunal also impleaded the (1) State of Uttar Pradesh through Additional Chief Secretary/Principal Secretary, Environment, Forest and Climate Change; (2) UPPCB through Member Secretary; (3) Chairman, APEDA; and (4) M/s Amroon Foods Private Limited, Barabanki, Amarsanda, Uttar Pradesh as respondents no.1 to 4 and ordered

issuance of notices to them with direction to file their responses within stipulated time as mentioned therein.

Reports of the Joint Committee

Pursuant to order dated 03.09.2024, report dated 03.10.2024 of the Joint Committee was filed by Regional Officer, UPPCB, Lucknow vide response affidavit dated 07.10.2024 (Pages 3 to 107 of the paper book) vide email dated 07.10.2024.

The relevant part of the response affidavit filed by Regional Officer, UPPCB, Lucknow vide affidavit dated 07.10.2024 reads as under:-

That in compliance with the order dated 03.09.2024 the Joint Committee comprising the Regional Officer, UPPCB, District Magistrate, Barabanki and D.G.M & Regional Head, APEDA, Varanai has carried the inspection of Respondent No.-4, M/s Amroon Foods Private Limited, Barabanki, Amarsanda, Uttar Pradesh on 19.09.2024. A copy of the Joint Committee Report dated 19.09.2024 is being attached herewith as Annexure NoR2/1 .

That during the inspection dated 19.09.2024 the Joint Committee has collected the sample from the Inlet and Outlet of the Effluent Treatment Plant (ETP) and also from the upstream and downstream of the Reth River and sent the sample to the authorized laboratory of the UPPCB. After analysis the sample collected are found within a prescribed standard as laid down. The copy of Analysis Reports is collectively being attached herewith as Annexure No.-R2/2 .

That the Respondent No. 4 has obtained Consent under Section 21/22 of the Air (Prevention and Control of Pollution) Act, 1981 from UPPCB and this consent is valid for the period from 01/01/2020 to 31/12/2024. A copy of the Consent order dated 20.12.2019 is being attached herewith Annexure No.-R2/3

7. That the Respondent No. 4 has obtained Consent under Section 25/26 of The Water (Prevention and control of Pollution) Act, 1974 and this consent is valid for the period from 01/01/2020 to 31/12/2024. A copy of the Consent order dated 17.12.2019 is being attached herewith Annexure No.-R2/4 .

8. That furthermore, in pursuance of the order dated 03.09.2024 passed by this Hon'ble Tribunal a notice has been served upon Respondent No.-4.M/s. Fair Export India Pvt. Ltd., Agasam, Kuna Road, District-Barabanki (earlier called as M/s. Amroon Foods Private Limited) vide letter dated 13.09.2024 through Speed Post. Furthermore, the copy of notice has also been served upon Respondent No.-4, by hand on 17.09.2024. A copy of letter dated 13.09.2024 alongwith postal receipt dated 14.09.2024 and receiving dated 17.09.2024 are being attached herewith Annexure No-R2/5 , Annexure No R2/6 and Annexure No.R2/7 respectively.

9. That it is pertinent to mention that in compliance with the directions issued by the Hon'ble Supreme Court in Writ Petition (C) No.330 of 2001 (Common Cause Vs. Union of India & Ors), Writ Petition No. 44 of 2004, Contempt Petition No. 124 of 2015 and connected Writ Petition (C) No. 309 of 2003 (Laxmi Narain Modi Vs. Union of India and Ors.), the State Government had issued the Government Order dated 07.07.2017 containing a 24 point compendium which all slaughterhouses have to comply with. The same was reiterated by the Lucknow of the Hon'ble High Court of Allahabad vide order dated 31.05.2023 in WRIT-C No 4368 of 2022. A copy of the Government Order dated 07.07.2017 is being attached herewith Annexure No.-R2/8 and a copy of the order dated 31.05.2023 passed by the Lucknow Bench of the Hon'ble High Court of Allahabad in WRIT-C6 No. 4368 of 2022 is being attached herewith as Annпеure No-R2/9.

10. That the Respondent No. 4 was inspected on 02.05.2024 to ascertain the status of compliance with the aforementioned 24 point compendium. The inspection report regarding compliance with the 24 point compendium is being attached herewith Annexure No.-R2/10.

11. That further it is also worthwhile to mention here that on 25.09.2024 the applicant has moved a representation before the District Magistrate, Barabanki. Local villagers have also given statements with regard to the Respondent No. 4. The copy of the representation dated 25.09.2024 is being attached herewith Annexure No.-R2/11 to this response and the statements of local villagers are being attached herewith Annexure No.R2/12.

point compendium. The inspection report regarding compliance with the 24 point compendium is being attached herewith Annexure No.-R2/10.

11. That further it is also worthwhile to mention here that on 25.09.2024 the applicant has moved a representation before the District Magistrate, Barabanki. Local villagers have also given statements with regard to the Respondent No. 4. The copy of the representation dated 25.09.2024 is being attached herewith Annexure No.-R2/11 to this response and the statements of local villagers are being attached herewith Annexure No.-R2/12. Report dated 03.10.2024 of the Joint Committee was considered by this Tribunal on 14.10.2024 and this Tribunal observed that the report showed that the project proponent is complying with consent and other conditions but there is no specific report on the question whether green belt has been maintained or plantation has been done and vide order dated 14.10.2024, this Tribunal directed the Joint Committee to submit specific report in this regard within 10 days.

Pursuant to order dated 14.10.2024, report dated 25.10.2024 of the Joint Committee was submitted by the District Magistrate, Barabanki vide letter dated 26.10.2024 (Pages 108 to 114 of the paper book). Compliance Report (Pages 127 to 137 of the paper book) regarding compliance with order dated 14.10.2024 was filed on behalf of respondent no. 1. Status report dated 25.10.2024 (Pages 115 to 126 of the paper book) incorporating the relevant part of the report dated 25.10.2024 of the Joint Committee was filed by Regional Officer, UPPCB, Lucknow. The relevant part of the status report is reproduced below:-

That in compliance to the order dated 14.10.2024 a Joint Committee comprising the representatives of District Magistrate Barabanki, DGM & Regional Head, APEDA, and Regional Officer, UPPCB has carried the inspection of Respondent No. 4, M/s Fair Exports (1) Pvt. Lad (Previous Name-M's Amroon Foods Private Limited): Agasan Road. Kuni, Uttar Pradesh on 25.10.2004. A copy of the Joint Committee Report dated 25.10,2024 is being attached herewith Annexure No-R2/1

6. That relying upon the Joint Inspection report dated 25.10.2024 it is to submitted here that the Respondent No-4, M/s Fair Exports Pvt. Ltd. (Previous Name-M/s Amroon Foods Private Limited) has produces 80 MT/day of frozen meat by slaughtering 750-cattle/buffalo and 750 sheep/goal per day.

That further in light of the order dated 14 10.2004 passed by this Hon'ble Tribunal and in pursuance to the compliance of the conditions as mentioned in Consent issued by the UPPCB, the UPPCB has sent a letter to the Respondent No.4 on 18.10.2024. The reply of the said letter has been sent by the Respondent No.4 on 22.10.2024. The copies of the said letter are collectively being attached herewith as Annexure No R2/2

That it is pertinent to mention here that in pursuance to the letter dated 22.10.2024 sent by the Respondent No. 4, a Joint Committee has also verify regarding the green belt area during joint inspection. During inspection and verification it is found that green belt has been developed with trees, plants and green parks which is more than the 33 percent of the total area, i.e. 41,762.9 Sq.Mt., out of total land area, i.e. 104,697 Sq.Mt. The photographs taken during the inspection regarding the green belt is attached with the Joint Inspection Report”.

Above said reports were considered by this Tribunal on 07.11.2024 and this Tribunal observed that the above said report of the Joint Committee have been prepared and signed by Dr. Arun Kumar Singh, Additional District Magistrate, Finance and Revenue, Barabanki, Dr. C.B. Singh, DGM and Regional Head, APEDA Facilitation Centre and Himanshu Sonkar, Assistant Scientific Officer, UPPCB but the Additional District Magistrate, Finance and Revenue was not a Member of the Joint Committee constituted by this Tribunal; that with respect to the issues highlighted by this Tribunal in its order dated 14.10.2024, a vague and non-specific report was submitted, merely stating that a green belt has been developed without disclosing essential details as to what kind of species of trees have been planted, how many trees have been planted and what is the exact area which has been developed as green belt; that despite the mandatory directions, neither respondent no. 2 nor respondent no.3 has provided a clear or specific reply addressing the issues raised and that compliance report has been filed by the State of Uttar Pradesh but there is nothing to show that the facts have

been verified by the concerned authorities. This Tribunal referred to directions issued by Hon’ble Supreme Court in W.P No. 330 of 200 titled as Common Cause versus Union of India and Others ; judgment dated 31.05.2023 passed by Hon’ble Allahabad High Court in Writ-C No. 4368 of 2022 titled as M/s Al Haq Food Pvt. Ltd versus State of U.P and Others and order dated 07.07.2017 issued by State Government and containing 24 points compendium which had to be complied with by all slaughterhouses and report dated 07.10.2024 (pages 163 to 267 of the paper book) filed by Regional Officer, UPPCB, Lucknow which mentioned that the premises of respondent no.4 were inspected on 02.05.2024 to ascertain status of compliance of 24 point compendium and placed inspection report on record (at page no.235 of the paper book) and observed that the report was incomplete and did not show compliance with the conditions stipulated in the said compendium. This Tribunal also expressed its anguish that respondents no. 2 and 3 have not given specific reply, particularly, in respect of pointed issues raised by this Tribunal in its order dated 14.10.2024 and even Joint Committee had not cared to verify facts and submit proper report in this regard.

Uttar Pradesh. In his affidavit DFO, Barabanki has merely mentioned that report Annexure-1 had been prepared in light of his extensive administrative responsibilities. In Annexure-1 it has been mentioned that in compliance of order dated 07.11.2024 a Committee under the Chairmanship of Divisional Forest Officer, Barabanki was constituted vide letter no. 2477/17-3 dated 13.11.2024 with Deputy DFO, Barabanki; Deputy DFO, Ramsanehi Ghat; Range Forest Officer, Deva Range; Range Forest Officer, Ramsanehi Ghat Range; and Range Forest Officer, Ramnagar Range and the Committee formed five teams which inspected the premises of slaughter house from 16.11.2024 to 05.12.2024 and found that 24,332 plants of 61 species (including aromatic species such as Eucalyptus globulus; Urtica dioica; Bauhinia variegate; Neolamarckia cadamba; Madhuca longifolia; Citrus limetta; Mimusops elengi; Murraya paniculata; Morus alba; Bombax ceiba; Tabernaemontana divaricate; Citrus limon; Delonix regia; Ficus racemose and Plumeria rubra) have been planted in the green belt area of 41762.9 sq. meters which came 39.88 % of total land area 104697 sq. meters; that the average age of the plants is 6 – 7 years and growth of the same is also good.

5. That the Respondent holds valid Consent to Operate (CTO) issued by the Uttar Pradesh Pollution Control Board (UPPCB). The CTO for air emissions, issued on 20.12.2019, and the CTO for water discharge, issued on 17.12.2019, remain valid until 31.12.2024. 6. That the Respondent operates under valid Consent to Operate (CTO) for air and water emissions, issued by the Uttar Pradesh Pollution Control Board (UPPCB). These consents are valid until 31.12.2024 and were issued after detailed scrutiny, ensuring compliance with all prescribed environmental norms.

¶144

7. That to address odor and air quality concerns, the Respondent has undertaken extensive greenbelt development, covering 41,762.9 sq. meters. This constitutes 39.88% of the total land area, far exceeding the mandatory requirement of 33%. The greenbelt comprises 24,332 trees across 61 species, including aromatic plants like Eucalyptus and Lemon Grass, which effectively mitigate odor and improve ambient air quality. A copy of the Divisional Forest Officer’s (DFO) Report, confirming this compliance, is annexed as Annexure C.

¶145

8. That the Respondent has installed a fully functional Effluent Treatment Plant (ETP) to treat industrial effluents generated during operations. The Joint Committee reports validate that treated effluent consistently meets the following standards: Total Suspended Solids (TSS): 50 mg/L, Biological Oxygen Demand (BOD): 30 mg/L, Chemical Oxygen Demand (COD): 250 mg/L, and Oil & Grease: 10 mg/L. Approximately 60% of the treated water is reused for irrigation, horticulture, and floor washing purposes, reflecting effective water management and resource optimization.

¶146

9. That the Respondent has installed and maintains a fully operational Effluent Treatment Plant (ETP) to treat all industrial effluents, the unit is fully complied considering the environmental norms.

10. The Respondent, M/s Fair Exports (India) Pvt. Ltd., has been permitted a maximum production capacity of 80 TPD (Tonnes Per Day) of frozen meat, which includes the slaughtering of 750 buffaloes and 765 goats/sheep per day,

as stipulated in the Consent to Operate (CTO) issued by the Uttar Pradesh Pollution Control Board (UPPCB) dated 17.12.2019. This capacity has been authorized specifically for the production of frozen meat and its by-products, including Meat Bone Meal and Tallow, ensuring compliance with all prescribed environmental norms.

11. That the Respondent holds a valid NOC for groundwater abstraction, issued by the Central Ground Water Authority (CGWA), valid until 03.08.2027. In addition, the Respondent has implemented a groundwater recharge project with an annual capacity of 123,180 cubic meters, demonstrating a proactive approach to water conservation. 12. That the unit is located at a safe distance from residential areas to ensure no adverse environmental impacts on nearby populations. Measures have been adopted to address all concerns raised by the Applicant, ensuring that grievances have been adequately resolved. The Respondent’s unit continues to implement improvements to maintain its status as a model

slaughterhouse, emphasizing environmental sustainability and public well being.

¶155

13. That the Respondent’s unit is located at a safe distance of approximately 2 kilometers from the nearest residential area or village. This distance adheres to prescribed siting norms for slaughterhouses and ensures no adverse impact on the health and well-being of nearby populations. 14. That the Green Audit Report, conducted by the National Productivity Council (NPC) in December 2024, comprehensively evaluated the Respondent’s environmental management systems. The report confirms that the Respondent’s air quality is “good and pollution-free,” effluent treatment meets prescribed standards, and waste management systems are effectively implemented. The green belt development, which is currently 39.88%. A copy of the Green Audit Report is annexed as Annexure E.

¶156

15. That the Respondent has developed a greenbelt covering 39.88% of the total land area, significantly exceeding the statutory requirement of 33%. The greenbelt, consisting of diverse tree species, including aromatic plants, serves to improve air quality, mitigate odor emissions, and enhance the environmental aesthetics of the premises.

¶157

16. That it is respectfully submitted that the Applicant’s grievances have been effectively addressed, and the Respondent has undertaken proactive measures to prevent recurrence of any such concerns. The unit’s compliance efforts have been verified by the Joint Committee, Divisional Forest Officer (DFO), and Uttar Pradesh Pollution Control Board, and no violations or adverse findings have been reported. Photographic evidence annexed to the inspection reports demonstrates the unit’s compliance with greenbelt requirements, waste management protocols, and effluent treatment standards.

4. That further it is stated that M/s Fair Export India Pvt. Ltd., located at Agasan, Kursi Road, Barabanki is a slaughterhouse unit with a production capacity of 80 MT/day of frozen meat by slaughtering 750 buffaloes and 750sheep/goats per day. The unit operates two rice husk-fired boilers with capacities of 6 TPH and 8 TPH, respectively. Both boilers are equipped with multi-cyclone dust collectors and stacks of 30-meter height from ground level. Additionally, the unit has an oil-fired boiler with a capacity of 4.5 TPH, also equipped with a 30-meterhigh stack. For the treatment of industrial effluent, the unit has installed an Effluent Treatment Plant (ETP) with a capacity of 800 KLD. The components of the ETP includes: Bar screen, Equalization tank, Rotary drum filter, Aeration tank- 1 & 2, Clarifier 1 & 2, Polishing tank, Sludge drying bed etc. The unit has installed a Rendering Plant for the treatment of solid waste and a Blood Meal Plant for processing of blood. Furthermore, the unit has installed a wet scrubber system cum bio-filter to control and remove foul odours generated during the rendering process.

5. That during the inspection, samples were collected from the outlet of the ETP, the upstream (Ws) and downstream (D/s) of the Reth River and the discharge point of treated effluent into the Reth River through a Hume pipe. All samples were

analysed by the Central Laboratory of UPPCB, Lucknow. As per the analysis report, the sample from the outlet of the ETP and the discharge point into the Reth River through the Hume pipe comply with the prescribed norms. The water quality of the upstream and downstream sections of the Reth River falls under Class "D," which is designated for the propagation of wildlife and fisheries.

6. That with regard to the verification of green belt and plantation as per conditions of Consent, an inspection was carried out by the team constituted by Divisional Forest Officer, Barabanki between 16.11.2024 to 05.12.2024 wherein it was noted that the Total Land Area is 104697 Sq.Mts, Total Built-Up Area is 28928.17 Sq.Mts and Green Belt Area is 41762.9 Sq.Mts (39.88%). There are total number of 24,332 trees including 61 species which is in compliance with the Specific condition No.-S of CTO dated 20.12.2019 issued by UPPCB. A true copy of the information received from the Divisional Forest Officer, Barabanki vide letter dated 07.12.2024 is annexed hereto and marked as Annexure R2/2.

I.A. No. 673/2024 was filed by the District Magistrate, Barabanki tendering unconditional apology for inadvertent non-compliance with the order dated 14.10.2024 passed by this Tribunal. I.A. No. 686/2024 was filed by District Magistrate, Barabanki seeking exemption from physical appearance and permission to appear virtually before this Tribunal on 23.12.2024 and this Tribunal exempted District Magistrate, Barabanki from physical appearance by allowing him to appear through VC. However, no specific orders were passed in respect of the same. Apology tendered vide I.A. No. 673/2024 is accepted and request made in I.A. No. 686/2024 already stands allowed and I.A. No. 673/2024 and I.A. No. 686/2024 are disposed of accordingly.

(India) Pvt. Ltd. (Formerly M/s Amroon Foods Pvt. Ltd.) and have gone through the material on record carefully.

It is evident from a perusal of the material on record that M/s Fair Export India Pvt. Ltd. (previously named as M/s. Amroon Foods Pvt. Ltd), located at Agasan, Kursi Road, Barabanki is a slaughterhouse unit with a production capacity of 80 MT/day of frozen meat by slaughtering 750 buffaloes and 750 sheep/goats per day. The unit operates two rice husk-fired boilers with capacities of 6 TPH and 8 TPH, respectively. Both boilers are equipped with multi-cyclone dust collectors and stacks of 30-meter height from ground level. Additionally, the unit has an oil-fired boiler with a capacity of 4.5 TPH, also equipped with a 30-meter-high stack. For the treatment of industrial effluent, the unit has installed an Effluent Treatment Plant (ETP) with a capacity of 800 KLD. The components of the ETP includes: Bar screen, Equalization tank, Rotary drum filter, Aeration tank- 1 & 2, Clarifier 1 & 2, Polishing tank, Sludge drying bed etc. The unit has installed a Rendering Plant for the treatment of solid waste and a Blood Meal Plant for processing of blood. Furthermore, the unit has installed a wet scrubber system cum bio-filter to control and remove foul odours generated during the rendering process.

During inspection on 08.12.2024 samples were collected from the outlet of the ETP, the upstream (U/s) and downstream (D/s) of the Reth River and the discharge point of treated effluent into the Reth River through a Hume pipe. All samples were analysed by the Central Laboratory of UPPCB, Lucknow. As per the analysis report, the sample from the outlet of the ETP and the discharge point into the Reth River through the Hume pipe comply with the prescribed norms. The water quality of the upstream and

downstream sections of the Reth River falls under Class "D", which is designated for the propagation of wildlife and fisheries.

Inspection of the premises of the slaughter house was carried out by the team constituted by DFO, Barabanki between 16.11.2024 to 05.12.2024 wherein it was noted that the slaughter house has total land area 104697 sq. meters, total built-up area 28928.17 sq. meters and green belt area 41762.9 sq. meters ( which is 39.88% of the total land area ) and there are total number of 24,332 trees of 61 species including aromatic species.

The Joint Committee inspected the slaughter house on 19.09.2024, 02.05.2024 and 25.10.2024 and UPPCB last inspected the slaughter house on 08.12.2024 and did not find violation of any environmental norms in its operation. Reports regarding compliance by the Project Proponent with 24Compendium conditions have been filed by the UPPCB and the State of Uttar Pradesh. On independent assessment regarding status of plantation, DFO, Barabanki has reported that 39.88% greenbelt has been developed by the Project Proponent. Reply regarding compliance with consent conditions /environmental norms has also been filed by the Project Proponent.

However, foul odours generated during the rendering process, we consider it to be appropriate that the respondent no. 4-Project Proponent be directed to take requisite ecological measures and further strengthen the green belt by launching multi- purpose tree species (MPTS) plantation programme on the boundary as well as inside the premises of the Project during this monsoon with emphasis on aromatic plants like Neem (Azadirachta sp.), Peepal (Ficus sp.), Pongamia (Millettia sp.), Amaltas ( Cassia sp.), Shisham (Dalbergia sp.), Satwan (Alstonia sp.), Bel ( Aegle sp. ), Imli (Tamarindus sp.), Jamun (Syzygium sp.) and also the aromatic shrubs/small trees like Madhu Kamini (Murraya sp.),

(Plumeria sp.), Jasmine (Jasminum sp.), Raat ki Rani (Cestrum sp.), Parijat (Nyctanthes sp.) by giving due priority to the same.

In view of the observations in the report of the Joint Committee and reports/responses filed by the State of U.P., UPPCB, DFO, Barabanki and also reply filed by respondent no. 4-the Project Proponent (M/s Fair Exports (India) Pvt. Ltd. (Formerly M/s Amroon Foods Pvt. Ltd.) regarding compliance with consent conditions stipulated by UPPCB, APEDA and directions issued by Hon’ble Supreme Court and Hon’ble Allahabad High Court, we are of the considered view that no intervention by this Tribunal in exercise of powers under the National Green Tribunal Act, 2010 is warranted and the original application is disposed of accordingly with the direction to respondent no. 4 to take requisite ecological measures and strengthen green belt as mentioned above and with the direction to respondent no. 2-UPPCB to periodically inspect the slaughter house for monitoring compliance with environmental norms and issue appropriate directions for improvement/implementation as may be required in accordance with law.
