We are passing this order in furtherance of our previous order dated 02.07.2024, wherein after submission of reply-affidavit by respondent No.3/ Project Proponent – M/s Inventys Research Co. Pvt. Ltd., same was analyzed by us in that order and thereafter, at the request of learned counsel for the MPCB, two weeks’ time was allowed to file rejoinder. Learned counsel for the MPCB then undertook to inform the applicant to ensure that he appears in this matter and files objections, if any against the affidavit/s filed by the respondents.

Today, learned counsel for respondent No.1 – MPCB states that after the aforesaid order dated 02.07.2024, additional affidavit-in-reply dated 12.11.2024 has been filed by respondent No.1 – MPCB, wherein it is submitted that respondent No.1 – MPCB, vide letter dated 02.04.2024, had issued direction to respondent No.3/Project Proponent to dispose of the hazardous waste i.e. spent sulphuric acid (H2SO4) of quantity 39860 kg at

CHWTSDF Taloja and submit disposal details to respondent No.1 – MPCB. Accordingly, respondent Industry has disposed of the spent sulphuric acid (H2SO4) of above quantity at the said site and submitted invoice copy dated 20.04.2024. Hence, in sum and substance, it is stated that the compliance of the order has been done by the MPCB and already, by our previous order, we have noted that the said acid dispatched by respondent No.3 was found fully intact as the same has been disposed of in safe and sound manner through the Mumbai Waste Management Ltd.(MWML). Therefore we do not find any evidence on record to the effect that any quantity of sulphuric acid was disposed of or dumped in nallah as per the news item.

As regards the service of notice upon the complainant, learned counsel for respondent No.1 – MPCB submits that the complainant was informed and copy of the order of this Tribunal’s order dated 02.07.2024 was also provided to him, but despite that, he has not appeared before this Tribunal and in proof thereof, an e-mail dated 03.03.2025 is sent to this Tribunal, which is on record, wherewith a copy of the order of this Tribunal dated 02.07.2024 is annexed whereon the complainant has made his signature. Hence, we find that the complainant does not want to file affidavit against the affidavits-in-reply filed by the respondents.

In the result, we do not find any substance in this case where any order is required to be passed by us. The Original Application is accordingly disposed of.
