The applicant- Devvrat Bhardwaj had filed an application under section 18 (1) read with Section 14 and 15 of the National Green Tribunal Act, 2010.

The applicant raise the grievance regarding encroachment by raising of illegal construction of religious structure over park/green area and seeking direction for removal of the encroachment and restoration of the park/green area.

This Tribunal disposed of the application vide order dated 18.01.2023 by directing Meerut Development Authority to take requisite action for demolition of illegal construction raised on the land of the park/green belt in front of plot no. 81 and 64 near the main entrance gate

between 9 meters wide road in the north and 12 meters road in the south in accordance with law within three months and respondents no. 1,2, 3, 5 and 6 were directed to provide requisite support including deployment of Police/Armed Police as may be required for the purpose and file report before the Registrar General, who was given liberty to place the matter before the Bench for further orders if considered necessary.

In compliance of order dated 18.01.2023 report was filed by MDA vide email dated 03.10.2023 and in view of non-compliance matter was listed before the Bench by registering Miscellaneous Application No. 116/2023.

Furter directions were issued by this Tribunal vide order dated 21.11.2023, 12.12.2023, 31.01.2024 and 24.04.2024.

Report dated 02.08.2024 was filed by respondent 4-MDA stating that a separate land for construction of temple had been made available whereon construction had been completed and idols shall be shifted from the disputed site after the month of Sawan i.e., 19.08.2024 and thereafter, illegal construction raised on the land earmarked for park shall be demolished. Sh. Rachit Mittal, Advocate appearing on behalf of MDA also made a statement to this effect during the course of hearing. In view of the above stand taken by MDA, Miscellaneous Application was disposed of by directing MDA to comply with the above undertaking and ensure shifting of idols and demolition of construction made on the land earmarked for park in Madhur Enclave and to restore the said area of park by taking steps for rejuvenation and restoration of park status by 15.09.2024 and submit a Compliance Report by 25.09.2024 before learned Registrar General who was given liberty to place the matter before the Bench in case of non-compliance.

In compliance of order dated 05.08.2024 report dated 25.09.2024 has been filed respondent no. 4-MDA. The relevant part of the report reads as under:-

Since direction of Tribunal to restore the said area of park by taking steps for rejuvenation and restoration has not been complied with the matter has been listed before the Bench for further orders by registering M.A. No. 60/2025.

Respondent no. 4-MDA is directed to take requisite steps for rejuvenation and restoration of the land in question as park by carrying out requisite plantation of the trees, plants, grass, bushes etc. and file further compliance Report within three months before learned Registrar General of this Tribunal who is given liberty to place the matter before the Bench in case of non-compliance/further order being considered to be necessary.

M.A No. 60 of 2025 is disposed of accordingly with direction as mentioned above.
