1. The above Miscellaneous Application [M.A. No.19 of 2024 (SZ)] is filed pursuant to our order dated 31.01.2023 in Original Application No.04 of 2023 (SZ).

2. The direction given was to the Tamil Nadu Pollution Control Board and also the Kilambadi Town Panchayat, within whose jurisdiction the shop is situated, to take appropriate action against the 5^th Respondent (M/s. V.V. Snacks) based on the complaint made by the applicant after affording them an opportunity of personal hearing and pass appropriate orders.

3. The Kilambadi Town Panchayat was not made as a party to the earlier proceedings. However, the District Collector – Erode District was a party.

¶24

4. Pursuant to our order, the Tamil Nadu Pollution Control Board had directed the Kilambadi Town Panchayat to take action against the 5^th Respondent in case of any environmental violations.

5. The learned counsel appearing for the applicant has stated that no such action has been taken. However, he has not clearly specified the nature of the complaints or the alleged environmental violations committed by the 5^th Respondent.

6. We once again direct the Tamil Nadu Pollution Control Board and the District Collector – Erode District to look into the matter and take appropriate steps to resolve the issue at their level.

7. Accordingly, the Miscellaneous Application [M.A. No.19 of 2024 (SZ) in O.A. No.04 of 2023 (SZ)] is disposed of. The applicant is at liberty to approach the authorities concerned for enforcement of the directions given.
