The appeal was earlier listed on 22.04.2025, when no one had appeared, therefore, it was adjourned to 26.08.2025. IA No. 312/2025 has been filed by the Applicant seeking preponement of the date of hearing. For the reasons assigned in the IA, the prayer is allowed and the Appeal is taken up for hearing on admission today.

By this Appeal filed under Section 16 read with Section 18 of the National Green Tribunal Act, 2010, the Appellant has challenged the order dated 04.03.2025 passed by the Punjab Pollution Control Board (PPCB) directing the disconnection of the electricity supply to the Appellant– poultry farm.

This being a statutory appeal, it is entertained.

Issue notice to the respondents for filing their response/reply by way of affidavit before the Tribunal at least one week before the next date of hearing through e-filing. The Appellant is directed to serve the respondents and file affidavit of service atleast one week before the next date of hearing.

It has been submitted by Counsel for the Appellant that apart from the impugned order, no other order has been passed by the PPCB directing closure of the Appellant’s unit and that the notice dated 30.08.2024 was issued to the Appellant of which the Appellant had filed reply dated 13.11.2024, but thereafter neither an opportunity of hearing has been given nor any separate order was passed and the impugned order also does not contain any reason.

Having regard to the submissions made above, we direct that the operation of the impugned order dated 04.03.2025 shall remain stayed till the next date of hearing, subject to the condition that the Appellant will comply with the applicable requirements of obtaining the CTE and CTO.
