This original application was earlier listed on 07.04.2025. When no one had appeared, therefore, it was adjourned to 08.08.2025. IA No. 294/2025 has been filed by the Applicant seeking preponement of date of hearing. For the reasons assigned therein, the prayer in the IA is allowed. The OA is taken up today.

In this original application, Applicant has alleged illegal felling of trees by the Project Proponent – Respondent No. 7, a real estate developer company, a subsidiary of Respondent No. 8. The allegation of the Applicant is that Respondents No. 7 and 8 have violated the norms by carrying out the activity in their project, namely, “The Omaxe State”, Sector 19-B, Dwarka, New Delhi. Learned Counsel for the Applicant has referred to the communication dated 02.01.2025 on page 145 to show that though the Environmental Clearance (EC) has been applied for the project, but has not been issued till now. He has also referred to the photographs filed from

page 106 onwards to show that earlier it was a green cover, but the Respondents No. 7 and 8 have cut a large number of trees.

Referring to the photographs from page 117 onwards, Counsel for the Applicant has submitted that even before grant of EC, the construction activities have been started by Respondents No. 7 and 8.

Issue notice to the respondents for filing their response/reply by way of affidavit before the Tribunal at least one week before the next date of hearing through e-filing. If any respondent directly files the reply without routing it through his advocate, then the said respondent will remain virtually present to assist the Tribunal. The Applicant is directed to serve the respondents and file affidavit of service atleast one week before the next date of hearing.

Till the next date of hearing, the official respondents will ensure that no illegal felling of trees takes place in the area concerned and the Respondents No. 7 and 8 do not indulge in raising any illegal construction thereon.
