ORDER

By this Execution Application, the Applicant is seeking compliance of order dated 14.05.2024 passed in Original Application (‘OA’) No. 171/2024.

The OA was registered on the basis of a media report disclosing death of 11 persons and injury to 4 persons in a Paint factory fire. The Tribunal by order dated 14.05.2024, while disposing of the OA had taken note of the fact that a sum of Rs. 10 Lakhs each was paid to the legal representative (‘LR’) of the deceased persons in the accident whereas they were entitled to Rs. 20 Lakhs, therefore, in respect of payment of differential amount the Tribunal had issued the following directions:-

Accordingly following the above order, we are of the opinion that family members of each of the deceased person are entitled to receive compensation of Rs. 20 Lacs without prejudice to higher claim that may be raised in any other forum. Hence, differential amount will be paid by SDM (Alipur) within two months with the right to recover it from project proponent.”

Learned Counsel for the Applicant submits that the Applicant has not received the differential amount till now. He has also referred to the chart in para 13 wherein the name of the Applicant is mentioned as the LR to the deceased Pankaj Kumar.

Issue notice to the respondents for filing compliance report by way of affidavit at least one week before the next date of hearing. If any respondent directly files the reply without routing it through his advocate then the said respondent will remain virtually present to assist the Tribunal.

The Applicant is directed to serve the Respondents and file affidavit of service atleast one week before the next date of hearing.

I.A. no. 244/2025 has been filed by the Applicant under Section 151 of the CPC seeking permission to file the Execution Application. Learned Counsel for the Applicant submits that though the Applicant was not a party in the OA but she is beneficiary of the order and order has been passed in her favour therefore she is entitled to apply for its execution. On due consideration, the IA is allowed.
