The Applicant has moved the present Original Application with the

following prayers:-

“1. That is, Allow the present Original Application filed by the Applicant;

2. Set aside and quash the order dated 09.06.2025 passed by the Sub-Tehsildar, Kanera, in Case No.03/2025 and Set aside and quash the order dated 08.10.2025 passed by the District Collector, Chittaurgarh, in Case No.013/202.

3. That is, Issue appropriate directions to respondents for protect and prevent any unauthorized non-agricultural use or construction on the agriculture land of Khasra No. 521, Village Kanera, Tehsil Nimbahera, District Chittaurgarh, Rajasthan;

That is, therefore, respectfully prayed that this Hon'ble Tribunal may restrain any unauthorized non-agricultural use or construction on the land; quash the action taken under Letter No. न्याय /2025/510 dated 01.10.2025 regarding the alleged encroachment removal on 06.10.2025; and direct the Respondents not to undertake any coercive or unlawful action in respect of the land.

That is, direct the Respondents to maintain the status quo on the said land and not to commence or continue any activity that may alter the nature, ecological character, or environmental integrity of the land. Further, it is submitted that instead of Khasra No. 521, the following parcels of barren land Khasra Nos. 625/254, 334, 875, 351, and 259 which remain unused and are under the ownership of the State of Rajasthan, should be duly surveyed, and necessary orders may be issued for the construction of the Government College building at the new village of Kanera, which is located nearby and accessible from Kanera.

That is, direct the Respondents to vest the Applicant with the responsibility for the protection and maintenance of all trees and plants planted by him, including all produce, fruits, or yields derived therefrom, for as long as such trees and plants continue to bear or produce in accordance with their age and maturity."

7. That is, direct an independent inspection and State Environment Impact Assessment Authority (SEIAA) of the said land by the concerned authorities or by a Local Commissioner appointed by this Hon'ble Tribunal, to ascertain the ecological, environmental, and legal status of the land.

8. That is, pass such other and further orders as this Hon'ble Tribunal may deem fit, just, and proper, in the facts and circumstances of the present case, in the interest of justice, equity, and environmental protection.”

The very first relief stated above pertains to quashing of order dated 09.06.2025, which is annexed at page 66 to 68 of the paper book, which is an order passed by the Tehsildar, Kanera, in Case No.03/2025 under Section 91 of the Rajasthan Land Revenue Act, 1956, Patwari Halka – Kanera, Tehsil Nimbahera, District Chittaurgarh Vs. Shri Prahlad S/o Ramlal , in which the issue was decided by the Tehsildar that Patwari of Kanera vide its report dated 18.03.2025 apprised that for construction of the proposed Government Degree College in Kanera, land has been allotted and during the identification of the said land, it was found that area 7.4900 hectares on Khasra No.521 is grazing land

as per revenue records and the same was encircled by bricks around it by raising a boundary wall upto 4 to 5 feet height and in that area several trees of Guava and Sitafal etc. were planted by one called Prahald who has encroached upon the said land. The said order was passed to the effect that the illegal encroachment be removed. It is against this order that the Applicant has come before us making it out to be an issue of environment, which we are not agreeing with.

It appears to be a personal dispute of the Applicant, therefore, he may approach the appropriate forum and not this Tribunal. We accordingly dismiss this Original Application at the admission stage itself.
