The Original Application has been registered on a letter petition sent by Aseem Chawla vide email dated 13.10.2023. On the basis thereof this Original Application has been registered in exercise of suomoto jurisdiction under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘ NGT Act 2010 ’).

We find from the record that complainant has sent his compliant a large number of authorities and copy of compliant on record is dated 17.08.2023 which is addressed to Registrar Punjab and Haryana High Court at Chandigarh and he states that term of elected Municipal Council, Barna has expired but Government has not got election conducted as a result of whereof baisc amentities are not being developing to the common people and they are living in unhygenic conditions.

There is another complaint to addressed to Chief Minister Government of Haryana perusal whereof shows that complainant grievance is that door to door collection of domestic waste is not operating for the two months and people are throwing waste on the vacant plots causiong damage to environment.

Further the employees of Sanitary Department can not be paid wages for the last four months. Drains are filled with garbage and entire work is lying stand still. Substantive complaint made in letter petitions is with regard to non of ……12:35… election or non-payment of wages to the Sanitary Department and in both the issues this Tribunal has no juridcition to interfere under Sections 14 and 15 of National Green Tribunal Act, 2010.

So far as the handling, managementd and transportation of solid waste in the city we are of the view, that this grievance can be looked into at the first instacne, by the concerned local authorities and they may take remedial action in accordance with law.

We accordingly, dispose of this Original Application by constituting a Joint Committee comprising District Magistrate, Ambala Haryana State pollution Control Board and Executive Officer, Municipal Council (Nagar Palika), Barara.

Deputy Commissioner, Ambala shall be the Nodal Agency for coordination and compliance of this order.

Above Committee shall visit the concerned areas and ensure that provisions of Solid Waste Management Rules, 2016 (hereinafter referred to as ‘ SWM Rules, 2016 ’) are complied with and observe in Boards and Executives strictly in the handling managemnet and transportation of

solid waste and its processing and if there is any violation the act remedial punitive and preventive action shall be taken agsinst the violator(s) in accordance. A Compliance Report shall be submitted by said Committee with within two months with Registrar of this Tribunal. If any further order is required Registrar General shall place the matter before appropriate Bench concerned.

With aforesaid directions this Original Application is disposed of.
