approved subject to deposit of 75 % development charges within the period permitted in the notice issued by the Nagar Parishad, Hisar. The Government of Haryana constituted a Committee vide notification dated 24.03.2009 for consideration of regularization of unauthorized constructions raised in the scheduled road controlled area. 20 plot holders out of 55 plot holders, who had raised unauthorized construction in the green belt, got the unauthorized constructions regularized. Subsequently, the remaining 35 plot holders, who had raised unauthorized construction in the green belt, filed appeals before the Tribunal headed by Justice J.C. Verma (Retd.). The Tribunal vide order dated 31.10.2014 directed that their request for regularization may be considered by the Competent Authority. However, the unauthorized constructions by said 35 plot holders were not regularized. Notices dated 18.01.2021 and 30.07.2021 under Sections 250 and 261 of the Haryana Municipal Corporation Act, 1994 were issued to all the 55 plots owners who had raised construction in the green belt in question. CWP No. 15110 of 2021 titled as Manish Kumar and others Vs. State of Haryana and others and CWP No. 15111 of 2021 titled as Kamla Devi and others vs. State of Haryana and others were filed in the Hon’ble High Court of Punjab and Haryana in which the learned Counsel for Municipal Corporation, Hisar made statement that a final decision with regard to the construction raised by the petitioners and the fate thereof would be taken in terms of passing of a reasoned order after taking into the consideration the replies submitted by the petitioners to the initial notice dated 18.01.2021. The Hon’ble High Court of Punjab and Haryana accepted the statement and disposed of CWP No. 15111 of 2021 vide order dated 19.08.2021 while directing that demolition of the construction of the petitioners which was the subject matter of the impugned notices dated 18.01.2021 would not take place meanwhile and would be subject to the outcome of the final order to be passed as per undertaking furnished by the
