Mr. Jai Ram Dass Chawla, resident of House No. 183, Sundar Nagar, Barwala Road, Hisar, Haryana has sent the present letter petition by post, which has been treated and registered as original application (OA No.474/2023) , complaining about encroachments over green belt on Delhi to Sirsa National Highway No.9 in Hisar, Haryana and improper selection of site for plantation of trees including Peepal and Bud (Bargad) over sewerage line and below 33 KV electricity line.

म वृ समाजसेवीहोनेकेनातेआपके ायालयकेअधीन ीनिट ूनलकोट िद ीम इसीतरहकाएककोट केसनं 847/2022 िदनांक 29.9.2022, रेफर सनं 1116013612022 िदनांक 21.10.2022 डाला आहै।परंतुअभी तकइसकेशकेबारेम कुछभीकाय वाहीनहीं ई।अगलीपेशी 5.7.2023 कोिनि त ईहै।

ह रयाणारा केिहसारशहरम बरवालारोडिहसारपुल ( िद ीिसरसा नेशनलहाईवे नंo. 9 पर ) सेलेकरिजओमैशतकलगभगआधािकलोमीटर ीनबे परहरेभरेबड़े - बड़ेपेड़पौधेकाटकरलोगोंनेअवैधिनमा णकर क ाकररखाहै।

इसकेअलावाइसअवैधिनमा णकेआसपासअवैधिनमा णव ीनबे के नीचेशहरकीब तलंबीचौड़ीसीवरेजलाइनभीहै।जबिकसीवरेजलाइनमे कभीभीसफाईनहींकीगई , उदाहरणकेतौरपरपंजाबरा केलुिधयाना शहरकीतरहब तबड़ाहादसाहोसकताहै।िजससेकाफीबड़ानुकसानहो सकताहै।

पतानहींिकसअिधकारीकेआदेश ारािहसारशहरकेवनिवभागके काया लय ारा 1 महीनेपहलेपीपलबड़आिदकेपेड़ब तबड़ीसीवरेज लाइनकेऊपरतथािबजलीिनगमकी 33 केवीलाइनकेतारोंकेनीचेपेड़ लगाएगएह ।जोिकमनु , जानवरों , पशुओंकेिलएिब ुलखतराहै।गलत जगहपेड़लगानेकेकारणसीवरेज व थाविबजलीकीस ाईभिव म घोरसंकटपैदाकरसकतीहै।

इसिलएमहामिहम ायमूित जीआपसे ाथ नाकरता ंिकवनिवभागिहसार ाराजोभीपेड़लगाएगएह , वोगलतजगहलगाएगएह ।ज ही पीड ूडीिवभाग ारानेशनलहाईवेकेसाथसिव सरोड़बनातेव पेड़ काटनेपड़ गे। िजसे ह रयाणा सरकार को राजसव तथा पेड़ों का अवैध काटने पर काफी नुकसान होगा। नेशनल हाईवे नंबर-9 की ीन बे पर जो भी अवैध िनमा ण िकया गया है। इसके आगे और पीछे नेशनल हाईवे रोड़ पर ीन बे पेड़, पौधे ह रयाली तथा पाक काबीज है। सोचने की बात है केवल इस जगह पर ही अवैध िनमा ण ों िकया गया है। कृपा, करके जनाब इस गलत काय परकिम र नगर िनगम िहसार तथा फॉरे ऑिफसर वन िवभाग िहसार ह रयाणा एवं नेशनल हाइवे औथोिट स, रोहतक ह रयाणा की लापरवाही तीत होती िदखाई जा रही है। इन िवभागों पर िनयमानुसार कार वाई करके जुमा ना लगाया जाए तथा वहां से ताजा गलत लगाए गए पेड़ हटवाए जाएं तथा असली जगह ीन बो म लगवाए जाएँ।

कृपाकरकेयहअवैधिनमा णतुड़वाकरकॉलोनीवािसयोंकेिलएपारकका िनमा णकरवानेकाफैसलादेनेकीमेहरबानीकर गे।मै तोसमाजसेवीहोनेके नातेलोगोंकीभलाईकेिलएअपनेखच परआपके ायालयम सहीफैसलेके िलएउ ीदलेकरआया ंभगवानसे ाथ नाकरता ंिकमेरीयहउ ीद आप ारासहीफैसलादेनेपरपूरीहोजाएगी तथा कृ ामेरेअ तीकी शा हेतुमु भीअवगतकरवाएँग ।“

Vide order dated 21.11.2023 this Tribunal impleaded State of Haryana through District Magistrate, Hisar; Commissioner, Municipal Corporation, Hisar; Haryana State Pollution Control Board through Member Secretary; Divisional Forest Officer, Hisar Division and Executive Engineer, Uttar Haryana Bijli Vitran Nigam (UHBVN) (which is ordered to be corrected as Dakshin Haryana Bijli Vitran Nigam (DHBVN) in order dated 21.11.2023 and memo of parties) as respondents No. 1 to 5 and ordered issuance of notices requiring them to file their reply/response within two months.

By the above said order this Tribunal also constituted a Joint Committee comprising of representatives of Haryana State Pollution Control Board; Divisional Forest Officer, Hisar and District Magistrate, Hisar and directed the same to meet within two weeks, undertake visits to the site, look into the grievances of the applicants regarding plantation carried out over sewerage line and under 33 KV electricity line, verify the factual position and submit factual and action taken report within two months.

In compliance thereof reply has been filed by the Regional Officer, HSPCB, Hisar Region vide email dated 13.03.2024 enclosing

therewith copy of the inspection report of the Joint Committee. The relevant part of the inspection report reads as under:

“ INSPECTION REPORT X X X X

The site of complaint i.e. about encroachments over the green belt on Delhi to Sirsa National Highway No.9 in Hisar, Haryana and improper selection of site for plantation of trees including Peepel and Bud (Bargad) over sewerage line and below 33 KV electricity line inspected today i.e. 30.01.2024 by joint committee i.e. Dr. Sunil Sheoran, Scientist-C representative of HSPCB, Sh. Surya Singh, Range forest Officer, Hisar and Sh. Ashvir Nain, Link Officer of ADC, Hisar w.r.t. Hon'ble NGT order dated 21.11.2023 passed In the Original Application No. 474/2023 in the matter of Jairam Dass Chawla Versus State of Haryana and Ors. During the inspection, the above-mentioned Joint committee has made the following observations: I. Municipal Corporation, Hisar has to remove the illegal encroachment over the green belt on Delhi to Sirsa National Highway No. 09. II. The small plants were found planted by the District Forest Officer, Hisar under the 33 KVA High tension electricity line.

III. The high-tension electricity wires are crossing & touching through the trees planted in this area. V. The plantation is made near the sewage line by the District Forest Officer, Hisar.

The joint committee has decided to send the letter to the concerned department i.e. Municipal Corporation, Hisar, DFO Hisar, Executive Engineer, DHBVN, Hisar & Executive Engineer, PHED, Hisar to take necessary remedial action to resolve the complaint”

The relevant part of the above said reply filed by the Regional Officer, HSPCB, Hisar Region reads as under:-

“ Reply on behalf of Joint Committee X X X X X After this Haryana State Pollution Control Board vide letter No. HSPCB/HR/2024/2935 dated 26.02.2024 requested to the Executive Engineer, DHBVN, Hisar, vide letter No. 2719 dated 02.02.2024 to DFO, Hisar. Vide letter No.2932 dated 26.02.2024 to PHED Hisar and Vide letter No. 3123 dated 05.03.2024 to MC Hisar to take necessary remedial actions to resolve the complaint.

4. Further, Superintendent Engineer (OP) Circle, DHBVN, Hisar vide letter No. T-83 dated 04.03.2024 submitted that the grievance has been redressed and resolved by trimming the old existing tree branches

which are close to the electric supply line. The copy of letter No. T-83 dated 04.03.2024 attached as Annexure R/2.

5. The DFO, Hisar vide letter No. 2647 dated 15.02.2024 submitted that the plants planted under the 33 KVA high-tension electricity line have been shifted to another place. Copy of letter No. 2647 dated 15.02.2024 attached as Annexure-R/3 .

6. The Executive Engineer, PHED vide letter No. 3083 dated 04.03.2024 submitted that neither trees nor plants exist on the sewage line of PHED at the abovementioned location. Copy of letter No. 3083 dated 04.03.2024 attached as Annexure R/4 . The matter of illegal encroachment of the abovementioned location is pending before the court of Divisional Commissioner, Hisar and before this honorable tribunal in 847/2022.”

Replies have also been filed by respondent no. 3-HSPCB vide email dated 13.03.2024 and by respondent no. 4-DFO, Hisar vide email dated 07.03.2024.

In its reply respondent no. 3 HSPCB has submitted that in view of the Joint Committee report action is required to be taken by Municipal Corporation (MC), Hisar, the District Forest Officer (DFO), Hisar, the Executive Engineer, PHED, Hisar and the Executive Engineer, DHBVN Hisar and no action in reference to the grievances raised in the application is required to be taken by HSPCB.

In his reply respondent no.4-DFO, Hisar has reported compliance and prayed for disposal of the application. Relevant part of the reply reads as under:-

2. That the present application of the applicant came to be listed on dated 21.11.2023 and the Hon'ble Tribunal vide its order dated 21.11.2023 directed the respondents to constitute a Joint Committee to verify the factual position and take appropriate remedial action.

3. That in compliance of the order of the Hon'ble Tribunal a Joint Committee was constituted and inspected the site on dated 30.01.2024 as mentioned in the application of the applicant. After inspection of the said site the Joint Committee made the following observations:-

(I) . Municipal corporation, Hisar has to remove the illegal encroachment over the Green Belt on Delhi-sirsa National Highway No.9.

(II) . The small plants were found planted by the District Forest officer, Hisar under the 33 KVA High tension electricity line.

(III). The High tension electricity wires are crossing and touching through the trees planted in this area.

(IV). The plantation is made near the sewerage line by the District Forest Officer, Hisar.

That in the inspection report observations number (II), (III), (IV) are related to the answering respondent and the answering respondent shifted all the small trees which were planted under the 33 KVA High tension electricity line and near the sewerage line on Delhi-Sirsa National Highway No.9 to another place.

5. That the answering respondent has complied the order of the Hon'ble Tribunal dated 21.11.2023 by shifting all the small trees which were planted under the 33 KVA High tension electricity line and near the sewerage line on DelhiSirsa National Highway No.9 to another place.”

We have heard the applicant and learned Counsel for the respondents no. 1 to 5 and gone through the material on record carefully.

It may be mentioned at the very outset that O.A No. 847/2022 titled as Jai Ram Dass Chawla & Anr. Vs. Municipal Corporation Hisar & Ors. has already been filed before this Tribunal regarding encroachments over the green belt in question and the matter is being separately dealt with on above said original application and no separate order regarding the same is required to be passed on the present original application.

The Joint Committee constituted by this Tribunal made the following observations in its Inspection Report:-

“X X X X (II) . The small plants were found planted by the District Forest officer, Hisar under the 33 KVA High tension electricity line.

(III). The High tension electricity wires are crossing and touching through the trees planted in this area. (IV). The plantation is made near the sewerage line by the District Forest Officer, Hisar. X X X X”

Observations number (II), (III), (IV) made by the Joint Committee in its Inspection Report have been complied with by respondent no. 4- DFO, Hisar by shifting all the small trees, which were planted under the 33 KVA High tension electricity line and near the sewerage line on Delhi-Sirsa National Highway No.9 to another place and by respondent no. 5-Executive Engineer DHBVN, Hisar by trimming the old existing tree branches which are close to the electric supply line.

In view of the above no further action is required to be taken by this Tribunal on the present application which is disposed of accordingly.
