This Original Application is registered suo-motu on the basis of the news item titled “Odisha 9 hospitalised after suspected gas leak at Rourkela Steel Plant” appearing in The Times of India dated 01.07.2024.

The matter relates to the hospitalization of nine people following a suspected gas leak incident at Rourkela Steel Plant in Odisha. As per the article, nine persons, including three officials and six contract employees felt unwell while working in the blast furnace number 5 after coming in contact with some gas. It is alleged that the leak was reported in a blast furnance of the plant.

The above news item indicates violation of the provisions of the Public Liability Insurance Act, 1992 and the Environment Protection Act, 1986.

The news item raises substantial issue relating to compliance of the environmental norms and implementation of the provisions of scheduled enactment.

Power of the Tribunal to take up the matter suo-motu has been recognized by the Hon’ble Supreme Court in the matter of “Municipal Corporation of Greater Mumbai vs. Ankita Sinha & Ors.” reported in 2021 SCC Online SC 897 .
