This original application is registered suo motu on the basis of the news item titled “ 1 djksM+ 14 yk[k dk eky tCr--- jsr ekfQ;k ds f[kykQ egkjk"Vª iqfyl dh dkjZokbZ ” appearing in ‘Aaj Tak’ dated 01.03.2024.

The news item relates to alleged sand mining in Bhima River near Pandharpur in Sholapur District of Maharashtra. As per the news item, illegal sand mining is in progress in Bhima River near the area concerned and the police has taken action against some of the persons responsible for the same and have seized JCB, Tipper and 4 bikes and has also registered FIR against 11 persons involved in illegal sand mining.

The news item raises substantial issue relating to compliance of the environmental norms, especially the provisions of the Sand Mining Guidelines, 2016 and Environment (Protection) Act, 1986.

Power of the Tribunal to take up the matter suo-motu has been recognized by the Hon’ble Supreme Court in the matter of “Municipal Corporation of Greater Mumbai vs. Ankita Sinha & Ors.” reported in 2021 SCC Online SC 897 .

Since the matter relates to the Western Zonal Bench of the Tribunal, therefore, the OA is transferred to the Western Zonal Bench, Pune for appropriate further action by impleading the concerned respondents. Let the original record of the OA be transferred to the Western Zonal Bench, Pune.
