This OA is registered on the basis of the letter petition received from one Jagsir Singh, General Secretary, Campaign against Corruption Hindustan (Regd.). In the letter petition the grievance has been raised against illegal operation of the Project Proponent i.e. IOL Chemicals and Pharmaceuticals Limited Factory VPO Fatehgarh, Chhanan- Near Village Dhaula, Mansa Road, District Barnala.

The grievance in the matter relates to discharging toxic water containing chemical though underground bores which are affecting the drinking water in the village Dhaula and Fatehgarh, Chhanna in District Barnala, Punjab.

The allegation is industrial unit IOL chemicals and pharmasueticals limited unit BPO Fatehgarh, Chhanna near village Daula Mansa Road District Barnala is letting out the industrial effluents

in the agriculture land damaging the crop and water. The toxic gases from the unit is also affecting the health of the villages.

In view of the above this Tribunal impleaded Punjab Pollution Control Board (PPCB), through its Member Secretary Ministry of Environment, Forest and Climate Change, Regional Office (NZ), Chandigarh, District Magistrate, Barnala, Central Pollution Control Board (CPCB), through its Member Secretary and IOL Chemicals and Pharmaceuticals Limited through its Administrative head as respondent.

A joint committee comprising of Member Secretary, CPCB, DM Barnala and Member Secretary was constituted and report sought.

The committee has submitted the report on 06.08.2024.

As per the said report the industry has installed two borewells drawing ground water and has a provision to utilize canal water to meet fresh water requirement for industrial purpose and domestic purpose. The Joint Committee has analyzed the groundwater sample collected from both the borewells and also from the borewells installed in the villages which are around 3 to 3.9 Km from the unit. All the water samples were analyzed in the PPCB Headquarters, Patiala. The trade effluent is bifurcated into two streams namely high TDS and Low TDS and specific method of treatment is adopted. The High TDS/COD effluent stream is treated and evaporated with four stage effect multi effect evaporator (MEE). While the low TDS/COD is treated through various processes and passed through RO - permeate and reused in the unit. The sludge obtained in the process is collected and sent to TSDF facility.

The counsel appearing for the unit informed that the unit is ZLD and no treated/untreated effluent is discharged in the drain or on the

land. The entire treated effluent is reused or treated through MEE system. Further the learned counsel for unit also provided an order of this Tribunal dated 20.12.2022 in O.A No. 722/2022 in Beant Singh Bajwa Vs. State of Punjab relating to the same matter and same applicant.

With regard to the sewage generated by the domestic source is treated as per norms and used in 38 Acre for plantation.

CPCB has also filed its response dated 09.08.2024 mainly reiterating the report of the Joint Committee.

In view of the findings of the Joint Committee and CPCB, we dispose of the matter with a direction to PPCB to monitor the unit periodically with regard to the water and air pollution.
