In this original application, the applicant has raised a grievance against the business operation of Respondent No. 6 & 7 by raising the plea that the said respondents are running a building material business in the shop no. 2328-2329, Main Bazar, Shah Abul Khair Marg, Turakman Gate Delhi. The plea of the applicant is that the building materials such as cement and badarpur are creating air pollution.

So far as the other allegations in respect of illegal storage, loading, unloading and obstruction in the flow of traffic are concerned, they are not related to the issue of pollution.

The record further reflects that the applicant has already made a complaint dated 01.07.2024 (annexure A-5) to the Chairman, DPCC and the plea of the applicant is that no action on the said complaint has been taken.

Having regard to the nature of the allegation which has been made in the O.A., we are of the view that the complaint of the applicant needs to be examined at the first instance by Respondent No. 1 DPCC.

Hence, we dispose of the O.A. directing the Chairman DPCC to duly look into the grievance of the applicant, ascertain the correct ground situation and if any violation of the environmental norms is found, take appropriate action in accordance with law by duly following the principle of natural justice.

Let this exercise be completed within three months of receipt of a copy of this order.

O.A. is accordingly disposed of.
