JUDGMENT
1. The above appeal is preferred against the decision taken by the SEIAA – Tamil Nadu (Respondent No.1), in its 717th Meeting held on 06.05.2024, in respect of the appellant’s proposal for grant of Environmental Clearance for quarrying rough stone and gravel over an extent of 1.00.0 Hectare at S.F. No.839/2 (part) of Sokkanur Village, Kinathukadavu Taluk, Coimbatore District.
2. Today, a memo dated 10.09.2024 is filed by the learned counsel for the appellant stating that,
“The above said Appeal has been filed by the Appellant J. Sathyan Praveen, challenging the impugned proceedings dated 06.05.2024 issued by the 1st Respondent as published in the official website, in so far as Item No.10 File No.10115 in the meeting No.717 held on 06.05.2024 is concerned and consequently directing the Respondents to pass orders granting Environmental Clearance for the Rough Stone and Gravel quarry lease granted for the patta land in S.No.839/2 (part) Sokkanur Village, Kinathukadavu Taluk, Coimbatore District, belong to the Appellant as per the proceedings of Assistant Director of Geology and Mining in Rc. No.771/Mines/2022 dated 27.04.2023.
In this regard, the Appellant J. Sathyan Praveen submitted letter of request addressed to the Counsel on Record in the reference cited, seeking to withdraw the Appeal No.49 of 2024 pending on the file of Hon'ble Tribunal by referring to the subsequent proceedings of SEIAA as well as the participation of Appellant in the Appraisal meeting No.493 held on 30.08.2024 on the premises that the Scientific report submitted by the Appellant is in active consideration for recommending Environmental Clearance for the File No. 10115.
Hence, I am withdrawing the Appeal filed before the Hon'ble Tribunal.”
3. In view of the above memo, the appeal [Appeal
No.49 of 2024 (SZ)] is dismissed as withdrawn.
