The petitioner is before this Court seeking for a direction to rectify

the petitioner's husband passport by reflecting his name as 'Sathik Batcha' instead of 'Sathicqu'. The petitioner's husband submitted a

representation with the Indian Embassy at Kuwait to rectify his name in the passport as 'Sathik Batcha' instead of 'Sathicqu'. The said application was forwarded to the third respondent herein. But the third respondent has not acted upon the said application.

Mr.M.Vaikkam Karunanithi, learned Government Advocate (Crl. side) appearing for the third respondent submitted that there is no provision for rectifying the name and therefore the petitioner has to obtain a decree from the jurisdictional civil Court.

The Ministry of Home Affairs, Government of India, has issued guidelines/circulars prescribing the documents that may be produced for issuance or correction of passport particulars. As per the said guidelines, documents such as Aadhaar Card, Elector’s Photo Identity Card (EPIC), Service Identity Card issued by the State or Central Government, Birth Certificate issued under the Registration of Births and Deaths Act, and other specified documents can be relied upon.

Aadhaar Card and PAN Card of her husband which indicate that the petitioner’s husband's name as 'Sathick Batcha' and not 'Sathicqu'.

In view of the above, this Court is of the opinion that the first respondent is bound to consider the request of the petitioner’s husband for correction of his name on the basis of the documents produced, subject to verification in accordance with law.

Accordingly, this writ petition is disposed of directing the first respondent to consider the petitioner’s request and re-issue the passport by correcting the name of the petitioner's husband as 'Sathik Batcha' instead of 'Sathiqu' in Passport No.P0724668. The said exercise shall be completed within a period of two(2) weeks from the date of receipt of a copy of this order.
