The present writ petition has been filed seeking to quash the show cause notice issued by the first respondent, wherein the petitioner has been called upon to submit his explanation with regard to the adverse police report received from respondents 2 to 4.

The learned counsel appearing for respondents 2 to 4 submitted that the petitioner was initially implicated in five criminal cases. Out of the said five cases, action has been dropped in three cases and, as on date, two criminal cases are pending against the petitioner.

The petitioner has been implicated in Crime No.190 of 2021 on the file of the second respondent, which has culminated in the filing of a charge sheet in C.C.No.684 of 2022 on the file of the learned Judicial Magistrate Court No.I, Srivaikundam. The petitioner has also been implicated in another criminal case in Crime No.56 of 2017 on the file of the third respondent police, which has culminated in the filing of a charge sheet in C.C.No.253 of 2023 on the file of the learned Judicial Magistrate Court No.II, Srivaikundam.

In view of the above facts, the petitioner is directed to approach the learned Judicial Magistrate Court No.I, Srivaikundam and the learned Judicial Magistrate Court No.II, Srivaikundam seeking permission to go abroad. If any such applications are filed, the same shall be disposed of by the concerned Courts within a period of four weeks. Based upon the orders to be passed by the concerned trial Courts, the first respondent is directed to proceed in accordance with law and, if permission is granted by the Courts, the impounded passport shall be released.
