Nargis Banu v. The Special Officer, Ammapattinam Village Panchayat and The Tahsildar, Manamelkudi Taluk, Pudukkottai District (W.P.(MD).No.35934 of 2025, Madurai Bench of Madras High Court, R. Vijayakumar J., decided 06.01.2026). By a writ petition under Article 226 of the Constitution of India the petitioner sought a Mandamus to be permitted to remove building debris from S.F.No.101/5 by considering her representation dated 12.11.2025, her construction on that survey number having been demolished by the Tahsildar (second respondent). Earlier, an eviction notice dated 22.10.2025 had been challenged in W.P.(MD) No.31121 of 2025, which was withdrawn after the demolition; a notice of 19.10.2023 had called upon the petitioner to remove the encroachment, and the second respondent contended he was entitled to recover demolition expenses before allowing debris removal. Counsel argued the demolition occurred without any notice under Section 7 of the Tamil Nadu Land Encroachment Act and without an order under Section 6 of the said Act. Finding from the records that admittedly no Section 7 notice and no Section 6 order of eviction had been issued, and deeming the case squarely covered by the Hon'ble Division Bench judgment in W.P.(MD) No.31385 of 2025, dated 06.11.2025 (which permitted debris removal on the ground that no eviction order was passed under Section 6 of the Land Encroachment Act), the Court allowed the writ petition, permitted removal of the building debris from SF No.101/5, and made no order as to costs. The Rs.1,50,000 demolition-cost figure appearing in the judgment arises solely within the quoted extract of the Division Bench case and does not relate to the present petitioner.
