The present writ petition has been filed by a student who is undertaking third year Engineering course in the 5^th respondent College seeking a mandamus directing the 4^th and 5^th respondents to permit him to resume his studies and attend the third year BE(Electronics and Communication Engineering) in the current academic year 2025-2026.

According to the learned Counsel appearing for the writ petitioner, he was not permitted to attend classes from 30.10.2025 onwards without assigning any reasons whatsoever. According to him, he has been wrongly implicated in some misconduct and on the basis of the said false allegations, he has not been permitted to attend the classes and he has also not permitted to stay in the Hostel.

Per contra, the learned Counsel for the respondent College submits that the petitioner was not permitted to attend the College due to some misconduct and the petitioner was aware of the same and voluntarily he is not been attending classes from 01.11.2025 onwards. The learned Counsel appearing for the College submits that in case if the petitioner wishes to get transfer certificate, they are ready to give Transfer certificate and return the eligible fees to the writ petitioner to enable him to pursue his studies in a different College.

The learned Counsel appearing for the writ petitioner, on instructions,

submits that the petitioner may not be willing to continue his studies in the respondent College and he would like to seek admission in a different College in case if the fee is refunded to him and all the academic records are returned.

The learned Counsel for the respondent College submits that the petitioner had paid a sum of Rs.45,000/- out of Rs.85,000/- as tuition fees and another sum of Rs.40,000/- out of Rs.82,000/- towards hostel fees. The Management is willing to return a sum of Rs.34,000/- to the petitioner.

In view of the above said facts, this Court is inclined to pass the following orders:-

a) The petitioner is directed to approach the 5^th respondent College inperson to collect all the certificates;

¶33

b) the 5^th respondent College is directed to refund a sum of Rs.34,000/- to the petitioner; and

¶34

c) the 5^th respondent College is further directed to issue a transfer certificate and a conduct certificate indicating the conduct of the petitioner as "Good".

With the above said observations, this writ petition stands disposed of.
