This Writ Petition has been filed challenging the impugned proceedings dated 06.04.2026 made in Na.Ka.No.H10/2806/2026 issued by the second respondent and for a consequential direction to the respondents 2 and 3 to issue a birth certificate of petitioner's daughter as R.Sri Nithiya, in-view of the representation dated 09.03.2026.

2. By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The learned counsel appearing for the petitioner submitted that the petitioner is the father of a female child, namely, Reya Tamil, who was born on 03.09.2011 at Arul Hospital, Pudukkottai, Tiruchirappalli District. At the time of

registration of birth, the child’s name was entered as “Reya Tamil” in the Birth Register and the second respondent issued the Birth Certificate accordingly. Subsequently, while the child was pursuing her studies, the petitioner and his family decided to change her name from “Reya Tamil” to “R.Sri Nithya”. The change of name was duly published in the Tamil Nadu Government Gazette, Part VI, Section 4, dated 04.01.2017, pursuant to the application dated 26.12.2016, at Serial No.85. Thereafter, the petitioner submitted an application dated 09.03.2026 before the second respondent under Section 15 of the Registration of Births and Deaths Act, 1969, seeking correction of the child’s name in the Birth Register. However, the said application was rejected by the impugned proceedings dated 06.04.2026. Aggrieved thereby, the present writ petition has been filed.

Per contra, the learned Counsel for the State appearing for the respondents submitted that, under Section 15 of the Registration of Births and Deaths Act, 1969, an entry in the Birth Register can be corrected or cancelled only if the Registrar is satisfied that the entry is erroneous in form or substance or has been fraudulently or improperly made. Unless the statutory requirements are satisfied, the petitioner is not entitled to seek correction of the entry.

This Court has considered the rival submissions and perused the

materials available on record.

The facts are not in dispute. Admittedly, at the time of registration of birth, the child’s name was entered as “Reya Tamil”. Subsequently, the petitioner’s family decided to change the name to “R.Sri Nithya” and the said change was duly published in the Tamil Nadu Government Gazette, Part VI, Section 4, dated 04.01.2017, pursuant to the application dated 26.12.2016, at Serial No.85. Once the State Government has officially published the change of name in the Government Gazette, there is no legal impediment for the respondents to carry out the corresponding correction in the Birth Register.

In view of the same, this writ petition stands allowed and the impugned proceeding dated 06.04.2026 is set aside. Consequently, the second respondent is directed to correct the petitioner’s daughter’s name in the Birth Register from “Reya Tamil” to “R.Sri Nithya” and issue a fresh Birth Certificate
