PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS, directing the first respondent to consider the petitioners three appeal memorandums dated 05.04.2024, 05.05.2024 and 18.05.2024 along with the documents and pass a suitable orders for setting aside the punishment awarded namely, 1. by the second respondent in his proceeding No.4333/A4/2021 dated 05.02.2024 granting the punishment of stoppage of increment with cumulative effect for the period of 1 year, 2. by the second respondent in his proceeding No.4550/A3/2022 dated 17.04.2024 granting the punishment of stoppage of increment with cumulative effect for the period of 1 year, 3. by the 2^nd respondent in his proceeding No. 2899/A3/2022 dated 08.05.2024 granting the punishment of stoppage of increment with cumulative effect for the period of one year.

ORDER

The grievance of the petitioner in this writ petition is that the petitioner herein suffered punishments in the hands of the second respondent on three occasions vide proceedings No.4333/A4/2021 dated 05.02.2024 granting the punishment of stoppage of increment with cumulative effect for the period of 1 year, vide his proceeding No. 4550/A3/2022 dated 17.04.2024 granting the punishment of stoppage of increment with cumulative effect for the period of 1 year and vide his proceeding No.2899/A3/2022 dated 08.05.2024 granting the punishment of stoppage of increment with cumulative effect for the period of one year. Aggrieved by the abovesaid orders of punishment, the petitioner claims to have filed appeal memorandums before the first respondent as early as on 05.04.2024, 05.05.2024 and 18.05.2024 respectively along with several other documents in support of his claim.

According to the learned counsel for the petitioner, the said appeals are still pending for consideration before the first respondent and no action has been taken as on date.

Mrs.K.Porkodi, learned Government Pleader appearing for the respondents submits that as the appeals are filed in accordance with Tamil Nadu Civil Services (Discipline and Appeal) Rules, the first respondent is bound to consider the same in accordance with law and the first respondent would pass appropriate orders on the said appeals expeditiously.

In the light of the above, without going into merits of the matter, this writ petition is disposed of directing the first respondent to pass orders on the appeals filed on 05.04.2024, 05.05.2024 and 18.05.2024 against the respective orders fo punishment as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a copy of this order. No costs.
