The Writ Petition has been filed in the nature of a Mandamus seeking a direction against the 3^rd respondent to remove the encroachments made by the 6^th respondent in Survey No.330 measuring an extent about 0.28.5 Ares in Veerakkal Village, Athoor Taluk, Dindigul District.

2.It is the contention of the petitioner that in S.No.330, there is a Government owned cart track, which passes through various other survey numbers also including S.Nos.331/1A2, 24/4, 2, 1, 23/2, 3b, 3A2, 333, 335/7a, 1b and 1a, used by the farmers and the general public. It had been stated that the 6^th respondent is owning lands in adjacent S.No.331/1A2. It is stated that she had obstructed the cart track.

4.A direction had been issued to the Tahsildar to make a physical verification and file a report. A report had been filed by the Tahsildar that there is no obstruction in S.No.330, which is classified as Salai Poramboke and used

as Vandipathai. Photograph has also been enclosed.

3.Additionally, the 6^th respondent had also filed a counter affidavit,

wherein, it had been stated as follows:

“9.I respectfully submit that, I have not obstructed any pathway, and the general public, including the petitioner, have free and unhindered access to Survey No.330. No official notice, show cause or eviction proceedings have been initiated against me by the revenue authorities alleging any encroachment.”

4.Recording all the above factors, we would close the Writ Petition

stating that as of now, there is no encroachment evident in S.No.330, which is

classified as Government Poramboke and used as Vandipathai. No costs.
