The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing Respondents 1 to 3 to remove the encroachment allegedly made by Respondents 4 to 6 on the public roadway situated in Survey No. 71/7B, S. Vallakulam Village, to remove the wooden materials and other scrap items stacked therein, and to initiate appropriate proceedings and dispose of the matter within a stipulated time frame.
2.By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.Mr. C. Jeganathan, learned counsel for the State, accepts notice on behalf of Respondents 1 to 3. Considering the limited relief sought by the petitioner, notice to Respondents 4 to 6 is dispensed with.
4.The contention of the petitioner is that Respondents 4 to 6 have encroached upon the public roadway situated in Survey No. 71/7B. Therefore, the petitioner has filed the present Writ Petition seeking appropriate action against Respondents 4 to 6.
5.The learned counsel appearing for Respondents 1 to 3, on instructions, submitted that there is no encroachment in the said survey number, except for the stacking of small wooden sticks. However, it is the duty of the official respondents to ensure that no encroachment is made and that no materials are stacked in the said survey number.
6.In view of the above, the official respondents are directed to ensure that no encroachment or unauthorized stacking of materials takes place in the said survey number.
