PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to return the jewel pledged by the petitioners deceased son namely Marikannu at the respondent bank vide Account No. 01710050300142 (Loan Account No.150916) to the petitioner based on the petitioners representation dated 16.05.2025 and pass any other appropriate order or relief as this Honble Court may deem fit in the circumstances of the case and thus render justice.

The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the respondent to return the jewels pledged by the petitioner’s deceased son, Marikannu, under Account No. 01710050300142 (Loan Account No.150916), to the petitioner.

Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner’s son died on 08.05.2024, leaving behind the petitioner and his two minor children as legal heirs. The wife of the deceased had predeceased him. The said Marikannu had availed a loan by pledging gold jewels. In order to redeem the same, the petitioner has discharged the loan, as evidenced by the receipt. The petitioner further states that the minor grandchildren are in his custody. Therefore, having discharged the loan, the petitioner is entitled to the return of the pledged jewels.

In view of the above, this writ petition is disposed of with a

direction to the respondent to return the jewels pledged by the petitioner’s deceased son, Marikannu, in respect of Account No.01710050300142 (Loan Account No.150916), to the petitioner, subject to the petitioner executing an indemnity bond. The said exercise shall be completed within a period of four weeks from the date of execution of the indemnity bond.
