This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to consider the petitioner’s representation dated 01.08.2025 and consequently issue patta in favour of the petitioner for the correct extent, in accordance with the Sale Deed dated 07.06.1951 bearing Document No.740/1951.

With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel for the petitioner submits that during the

Natham Survey and Resettlement conducted in the year 1993, the petitioner’s landed property was wrongly classified as Government Natham Poramboke / Government land; that the petitioner approached the third respondent seeking rectification of the said error and issuance of patta in the name of the petitioner; that despite several attempts made by

the petitioner, the third respondent passed an order dated 10.02.2025, after

obtaining a report from the fourth respondent.

He further submits that earlier the fourth respondent, after conducting a survey, had submitted a report to the third respondent stating that the extent of the property was correct and in accordance with the decree dated 09.01.1984 passed in O.S.No.415 of 1981 on the file of the Principal District Munsif Court, Sattur, Virudhunagar District. However, in the order dated 10.02.2025, the extent mentioned is incorrect and contrary to the said decree and the Sale Deed dated 07.06.1951.

He further submits that the petitioner thereafter submitted a representation dated 01.08.2025 seeking issuance of patta as per the extent mentioned in the decree and the title deed and since no action has been taken thereon, the petitioner has approached this Court.

6. The learned Additional Government Pleader appearing for the respondents would submit that instead of filing an appeal against the order dated 10.02.2025, the petitioner submitted a representation dated 01.08.2025 to the first respondent; that the said representation dated

01.08.2025 would be treated as an appeal and forwarded to the second respondent, who is the appellate authority; and that the appeal would be disposed of by the second respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Court directs the first respondent to forward the said representation dated 01.08.2025, if not already forwarded, to the second respondent within a period of one week from the date of receipt of a copy of this order. On receipt of the said representation, the second respondent shall treat the same as an appeal against the order dated 10.02.2025 passed by the third respondent and shall consider and dispose of the same on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The appeal shall be disposed of after conducting an enquiry. The second respondent is also directed to afford a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing final orders. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court.
