This Writ Petition has been filed challenging the impugned proceedings of the first respondent made in No.554/Vu.Tha.2/2026 dated 24.05.2026 and for a direction to the first respondent to the grand 21 days ordinary leave to the petitioner's husband, who is a life convict undergoing sentence at Central Prison, Madurai.

The petitioner's husband is a life convict undergoing sentence at Central Prison, Madurai. The petitioner made a representation seeking for ordinary leave on the ground that the convict has to make financial arrangements for the education of the children and also for the repair of the house. The said representation came to be rejected by the first respondent through the impugned proceedings dated 24.05.2026 on the ground that there is one pending case against the convict. Aggrieved by the same, the present Writ Petition has been filed before this Court.

The learned Counsel for State of TN (Crl.Side) submitted that the convict has undergone sentence of 3 years, 10 months and 15 days and twice he was granted emergency leave and no ordinary leave has been granted till date.

Taking into consideration the facts and circumstances of the

case and considering the reason, for which the ordinary leave has been sought for and taking note of the sensitivity of the matter involved in this case and also taking note of our earlier orders, where we have granted ordinary leave for two of the convicts, we are inclined to interfere with the

impugned proceedings of the first respondent dated 24.05.2026 and the same is hereby set aside and there shall be a direction to the first respondent to grant 21 days ordinary leave subject to the condition that the convict shall report before the Inspector of Police, Manamadurai Town Police Station, Sivagangai District daily at 5.00 PM during the entire ordinary leave period. The other conditions imposed by the first respondent shall stand as they are and the sureties shall be executed before the jail authorities.
