This writ petition has been filed for direction directing the respondents 1 to 3 to provide adequate police protection to the petitioner to enable the petitioner to peacefully enjoy and protect his property situated in survey No.322/6A and 322/5, Vallipuram Village, Namakkal District and to put up and maintain fencing around the said properties without any obstruction or interference from any private parties, terms of the final civil court decrees.

2.The petitioner submitted complaint seeking police protection to fence his property. On perusal of records reveal that the petitioner and his wife already approached the civil Court in respect of

the subject property for declaration and injunction and the same was decreed in O.S.No.87 of 2012 and O.S.No.48 of 2014 before the learned Sub Judge, Namakkal on 01.12.2015. It was also confirmed upto the Hon’ble Supreme Court. Even then, the fourth respondent is disturbing peaceful possession and enjoyment.

3.In view of the above, the third respondent is directed to conduct enquiry on the complaint lodged by the petitioner, after issuance of notice to the petitioner and fourth respondent and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order in the light of the civil Court decree in O.S.No.87 of 2012 and O.S.No.48 of 2014. It is also made clear that if any cognizable offence is made out against the fourth respondent, the third respondent is directed to register FIR and proceed in accordance with law.

4.With the above direction, the writ petition is disposed of.
