The petitioner – accused, facing trial in Crime No.82 of 2025 for the offences punishable under Sections 420, 506(1) and 120B of IPC, had filed an anticipatory bail application in Crl.O.P.No.28902 of 2025 before this Court and this Court by an order dated 04.11.2025, granted anticipatory bail to the petitioner.

2.The contention of the petitioner is that while the anticipatory bail was granted, there is no such condition restricting the petitioner’s travel to abroad. Now, the petitioner has not been permitted to travel abroad. The petitioner is an Entrepreneur, who needs to travel to foreign countries and further, in paragraph No.8 of the anticipatory bail order dated 04.11.2025, he submitted that A4 and A5, during interrogation was identified that Rs.9 crore worth property were available and they can be attached in the case. That was one of the reason for granting anticipatory bail to the petitioner. He further submitted that a civil suit is pending in OS.No.6898 of 2024 before the IV Additional City Civil Court,

Chennai. In view of the same, restriction on the petitioner’s travel amounts to denial of fundamental right. Travel by a person is a fundamental right and it 2 / 8

cannot be curtailed at the whims of the investigation agency. The further contention of the petitioner that the petitioner appeared before the respondent on several dates from 19.05.025 and the investigation is moving on at a snail speed

and the petitioner is not permitted to travel. Hence, this petition.

3.The learned Additional Public Prosecutor appearing for the 1^st respondent submitted that in this case there are totally five accused persons and the petitioner is accused No.1. The petitioner is a Non-Executive Director of M/s.Futuristic Global Resources Pvt. Ltd. Accused Nos.4 and 5 are Directors,

who are the close relatives of the petitioner. The petitioner projected there are various contracts of mining have been allotted worth several crores of rupees, which can be sublet to the defacto complainant and the defacto complainant had paid Rs.10 crores to the accused and Rs.6 crores have been transferred to the account of M/s.Futuristic Global Resources Pvt. Ltd., and the remaining Rs.4

crores were available as cash with the petitioner and A4 and A5. The bank

4.He further submitted that the accused persons have adopted similar modus operandi to cheat various persons with same pattern of behaviour in the name of business and Crime No.182 of 2025 is one among the same. He further submitted that a case was registered in CCB in Crime No.99 of 2023 dated 26.04.2023 is being investigated on the similar lines. Further, a complaint has also been registered in C.No.416/CCB/COP/Visitors/2023, which is now been transferred to Ramnad on the point of jurisdiction. The petitioner also having a

company in the name and style of M/s.Muthamizh Padaippagam and there are many transfers made between the bank accounts within the said companies. Though it was projected as Rs.9 crores of properties were available as regards the present crime number, it was found that only 3 cars had been identified and secured, which is valued less than Rs.1 crore. The petitioner has not approached with proper reasons to revoke the LOC. The LOC is the confidential document and the petitioner cannot claim to furnish copy of the same to him. Further, in this case, the investigation is not completed and the petitioner is the master mind of the said offence and the charges are grave in nature and only to escape from the Country, the petitioner has filed this petition and prayed for dismissal of this petition.

5.Heard the learned counsel on both sides and perused the materials on record.

6.Earlier, this Court by an order dated 02.01.2026 in Crl.O.P.Nos.35056 and 35059 of 2025, after hearing the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for respondents 1 to 3 therein, had directed the 2^nd respondent therein not to continue with the investigation in Crime No.82 of 2025 and Crime No.182 of 2025.

7.Stay of the investigation would not straight away tantamount to restricting the travel of the petitioner. If the petitioner is willing to travel to a particular country for a particular period, he can give all the details to the respondent and seek for travel permission for a limited period with permission.

8.With the above, this petition is disposed of. No costs.
