aged about 31 years S/o Manoharan (PID No.212274 who now confined in Central Prison, Coimbatore as a life convict) based on petitioner representation dated 11.06.2026 to provide medical treatment his right leg and to surgically remove the plate that was inserted during a previous surgery in his right leg, which was fractured in an earlier accident, as it is now causing severe pain and pass orders as this court may deem fit to the circumstances of the case and thus render justice.

The petitioner had sought emergency leave for her husband Arun @ Arunkumar, confined in Central Prison, Coimbatore, who is a lifer.

The reason for rejection is that the Tamil Nadu Suspension of Sentence

Rules, 1982 (in short, ‘Rules’) do not contemplate the grant of emergency leave for medical purposes of the convict himself and hence the reasons cited do not fall within the ambit of the situations adumbrated under Rule 6, providing for emergency leave.

Since the convict was expressing some medical ailments, we had by

our order dated 14.7.2026 directed as follows:-

Prima facie, the prayer in this writ petition cannot be entertained as there is no provision for grant of emergency parole for 20 days without escort, particularly, since the leave sought is for the medical ailment of the convict himself. In fact, it is on this ground that the representation of the petitioner has been rejected.

2. Having said so, it is for the prison authorities to attend to the medical needs of the convicts promptly. The petitioner, states that Arun @ Arunkumar lodged in Central Prison, Coimbatore, is facing severe pain on account of plate inserted in his right leg on account of fracture. Hence, there is a direction to the authority to attend to the medical ailment of Arun @ Arunkumar, lodged in Central Prison, Coimbatore, within a period of a day and file a report on 16.07.2026.

Today, a report is filed by the Assistant Surgeon of the Central Prison,

Coimbatore after examination of the convict on 15.07.2026 making the following diagnosis:

“Present status for the petitioner Arunkumar (CT-23468). He has seasonal asthmatic. He has old history of fracture both bone Right Leg around 2017, for which he had undergone surgery ORIF with implant EXIT. For which, orthopeadic has advised from Coimbatore Medical hospital for implant EXIT”.

In light of the aforesaid, where the Doctor advices medical attention for

the convict, the convict may either subject himself to necessary treatment from the Coimbatore Medical College Hospital for ‘implant EXIT’ as advised by the

prison doctor or, if he is inclined to avail services from a private hospital, he may make such a request to the authorities, who shall on receipt of such request, permit the same at his costs, and per Rules.
