The husband of one Sarojini, who has been convicted with imprisonment

for life with fine and is presently in Special Prison for Women, Puzhal, Chennai

has approached this Court challenging order dated 23.05.2026 wherein, while granting her 28 days ordinary leave, the authorities have imposed the condition of escort. It is as against the imposition of that condition, that the present writ petition has been filed.

2.Mr.C.R.Malarvannan, learned counsel for Government of Tamil Nadu (Criminal Side) who appears for the respondents has circulated the proforma setting out the details of the convict, including the details of leave availed thus far.

3.We find that she has undergone total imprisonment of 11 years, 4 months and 24 days as on 14.07.2026. She has availed, in toto, only 10 days of leave thus far, and that too with the intervention of this Court in WP.Crl.No.413 of 2025 order dated 08.09.2025.

4.The entitlement of the convict to leave as per the Tamil Nadu Suspension of Sentence Rules, 1982 is not in doubt. The report of the probation officer is in her favour and there is nothing untoward stated therein that would necessitate the imposition of condition relating to escort.

Over and above that Mr.Malarvannan, on instructions, also does not very seriously object to the modification of the condition related to imposition thus far. Hence, we modify order dated 23.05.2026 and direct the authorities to permit the convict to avail leave of 28 days (ordinary leave) commencing from 17.07.2026 without escort on the following conditions:

(i) Respondents are directed to release the Convict Prisoner viz., Sarojin i, W/o.Jai Singh, aged 40 years, confined at Special Prison for Women, Puzhal, Chennai on Ordinary Leave for a period of 28 days i.e., from 17.07.2026 to 13.08.2026.

(ii) The Convict Prisoner shall be released on 17.07.2026 at 10.00 am and she shall surrender before the Superintendent of Prison, Special Prison for Women, Puzhal, Chennai on 14.08.2026 before 10.00 a.m.

(iii) The Convict Prisoner is directed to report before the Inspector of Police, M3 Puzhal Police Station, Chennai every alternate day at 10.30 a.m., during the period of leave.

(iv) The Convict Prisoner shall utilize the leave only for the ground on which it has been granted and shall not indulge in any other activities.
