ORDER

This writ petition has been filed seeking a mandamus to the respondents to consider the transfer request of the petitioner from Chennai to the place in and around Madurai or nearby Dindigul District on the basis of the representation dated 23.01.2026 within a time to be stipulated by this Court.

It is the case of the petitioner that he was appointed as Junior Assistant on 11.08.2000 in the Prosecution Department and subsequently, he appeared in TNPSC Group-II examination, got selected and appointed as Assistant Inspector Local Fund Audit on 20.08.2008. Thereafter, he was promoted as Deputy Inspector and then as Inspector during 2016, in which post, he continues as on date. It is the further case of the petitioner that while he was working at Dindigul during February 2021, on a surprise inspector, his name was brought in and after preliminary investigation, every allegation against him stood dropped, however, he was transferred from Dindigul to Chennai. As his wife is employed as Assistant in ESI Hospital, Madurai and his children are going to college, he sent a representation dated 29.12.2025 following by the reminder dated 23.01.2026 seeking transfer in and around Madurai and nearby Dindigul District. Since his request for transfer has not been considered by the respondents so far, he has filed the present writ petition.

Heard the learned counsel on either side.

The learned counsel appearing for the petitioner would submit that

it would suffice, if a direction is given to the respondents to consider the representation and reminder of the petitioner dated 29.12.2025 and 23.01.2026, respectively and pass appropriate orders within a time frame to be stipulated by this Court, for which, the learned Additional Government Pleader appearing for the respondents has no serious objection.

In view of the limited relief sought herein, which has not been seriously opposed on the side of the respondents, this Court, without going into the merits of the case, directs the first respondent to consider the petitioner’s representation dated 23.01.2026, if not considered earlier and pass appropriate orders, on merits and in accordance with law, after affording an opportunity of hearing to all the parties concerned, on or before 15.04.2026 .

With the aforesaid direction, this writ petition stands disposed of. No costs.
