The petitioner has approached this Court seeking a direction to the second respondent to consider the representation submitted by the petitioner and to restrain the respondents from proceeding further in respect of the property bearing No.37, Thiyagi Logayya Street, Velayutham Colony 2 nd Street, Saligramam, Chennai – 600 093.

2. The petitioner contends that it is running a school and that the subject

property had been allotted for the purpose of implementing the Noon Meal Scheme for the benefit of the students. It is further submitted that the patta issued in respect of the property reflects the petitioner’s occupation thereof. According to the petitioner, the officials of the respondent Corporation are unlawfully interfering with its peaceful possession and enjoyment of the property and are threatening to demolish the building situated thereon.

W.P.No.7585 of 2025 3. A counter affidavit has been filed by the respondent Corporation stating that the building situated on the subject property was in a dilapidated and unhygienic condition. It is stated that, pursuant to complaints received from the local residents, the Corporation took possession of the property in view of the unsafe condition of the building.

The Corporation has further stated that the petitioner has not produced any document, such as a lease deed or licence agreement, authorising its occupation of the Corporation land for running the school. It is also stated that the petitioner had failed to maintain or secure the premises by fencing or cleaning the property. Consequently, the officials of the Greater Chennai Corporation cleaned the premises on 24.01.2025 and, thereafter, demolished the dilapidated structure on 12.02.2025. Since then, the Corporation has been in possession of the property.

5. It is not in dispute that the property belongs to the Greater Chennai Corporation. The petitioner’s claim is that it was permitted to use the property for the purpose of implementing the Noon Meal Scheme. However, the petitioner has not produced any material to establish that the property had been

W.P.No.7585 of 2025 leased or licensed in its favour or that the Corporation had dispossessed it during the subsistence of any such lease or licence.

6. It is also an admitted fact that possession of the property has already been taken over by the Corporation and the building standing thereon has been demolished. In view of the subsequent developments, the relief sought for in the present writ petition no longer survives for consideration.

Accordingly, the Writ Petition is disposed of, reserving liberty to the petitioner to submit an appropriate representation to the respondent Corporation seeking grant of the subject property on lease or licence for the purpose of running the school and implementing the Noon Meal Scheme. If such a representation is submitted, the Respondent No.1 Corporation shall consider the same on its own merits and in accordance with law. No costs.
