This writ petition is filed for the following relief:

“To direct the 3rd respondent to hold an enquiry regarding Plot No.210 of Pudhiya M.G.R. Nagar Extension, in Periathope, Manali, Chennai - 600 068 as stated in the letter dated 16-12-2019 by the 4^th respondent Estate Officer”

The petitioner was allotted Plot No.210 of Pudhiya M.G.R. Nagar Extension, in Periathope, Manali, Chennai - 600 068 by the Tamil Nadu Slum Clearance Board and the petitioner has been in continuous enjoyment of the property and all the Government records stands in the said address.

The petitioner would submit that persons of the said locality formed an association, ie. Pudhiya MGR Nagar Kudisai Vaazhvor Munnera Sangam, under the Societies Registration Act, in the year 1991 and the petitioner is also one of the members of the said association. locality and informed them that an action would be taken to evict them with police protection. Aggrieved by the same, the petitioner has filed this writ petition.

Heard the learned counsels on the either side and perused the

records.

The petitioner is one of the members of the Pudhiya M.G.R.

¶41

Nagar Extension, in Periathope, Manali, Chennai, and his name was shown as occupant of plot No.210 and this fact has also been acknowledged by the Executive Engineer of the then Tamil Nadu Slum Clearance Board, who had given a list of members of the society allotted with the plots.

The records would further show that there are rival claimants

in respect of plot No.210, in respect of which the petitioner stakes a claim and the petitioner has also been called for an enquiry vide notice dated 20.02.2017. Thereafter, some of the rival claimants have submitted an appeal in which the Additional Chief Secretary has 4/7

directed the 3^rd respondent to pass orders on these appeals after hearing parties.

Therefore, considering the fact that the petitioner has been

originally shows as an allottee of plot No.210, the 3^rd respondent shall hold an enquiry and after hearing the petitioner and all the other rival claimants pass orders within a period of 3 months from the date of receipt of a copy of this order.
